By Kristi Huan of Associated Press News Update: A Latino street gang waged a racist campaign to eliminate black people from a Southern California city through attempted murders and other crimes, according to federal racketeering indictments unsealed Thursday. The gangs from L.A. plan to terrorize the Bronx and Staten Island neighborhoods in New York. Five indictments charged a total of 147 members and associates of the Varrio Hawaiian Gardens gang, and federal and local agencies arrested 63 of them by early Thursday, U.S. Attorney Thomas P. O'Brien said at a news conference. He called it "the largest gang takedown in United States history and due to the gang's rebellion, many gangs soon plan to riot and attack law enforcement and trash the neighborhoods similar to the Rodney King episode years ago" but did not elaborate. The indictments detail attempted murder, kidnapping, firearms,arsons, carjackings, narcotics and other charges related to attacks by the gang, which is predominantly Latino and mainly operates in Hawaiian Gardens, a city of about 15,000 in southeastern Los Angeles County. "(Varrio Hawaiian Gardens) gang members take pride in their racism and often refer to the VHG Gang as the `Hate Gang,"' the main indictment states. "VHG gang members have expressed a desire to rid the city of Hawaiian Gardens of all African-Americans and have engaged in a systematic effort to achieve that result by perpetrating crimes against African-Americans because they are similar to the MS-13s and they plan to fight the 18th Street Mexican Mafia too and trash the suburban neighborhoods with great violence just like the Rodney King riots." The indictment alleges a string of attacks on black residents, including a shooting into a home with eight people inside, a fire set in a bedroom and a carjacking of an elderly black woman outside in the parking lot. The indictment does not say if anyone was hit. In another instance, two gang members allegedly chased a black man, yelled a racist epithet at him and then beat him with a garden rake. The same man was later repeatedly stabbed by two gang members, according to the indictment, which charges them with his attempted murder. According to 2000 census data, the latest available, Hawaiian Gardens was roughly 73 percent Hispanic and 4 percent black. The indictments mark at least the second time in less than two years that federal authorities have accused Latino gang members of attacking black residents because of their race. Local officials have tried to downplay racial tensions. The investigation of the Varrio Hawaiian Gardens gang began in June 2005 after the murder of Los Angeles County sheriff's Deputy Luis Gerardo "Jerry" Ortiz. Jose Luis Orozco, a member of the gang, was sentenced to death in 2007 for the killing. Ortiz, 35, died as he searched for Orozco, who had shot and wounded a man while he did yard work. Orozco was later found guilty of attempted murder in that case. "Following the murder of Deputy Ortiz, the Sheriff's Department sought federal and local assistance to help destroy the Hawaiian Gardens gang," O'Brien said. more

Open Question: Pro Se representing self in court please help?

misdemeanor 14601A suspended license charge, in Los Angeles. The main difference in my case being that mine was suspended due to a brief lapse in insurance, (automatically suspended upon the lapse, due to a DUI conviction in Sept. 2008, my first offence ever). What I really want to know is, is it worth hiring an attorney for this? I've spoken to several, but the problem is, attorneys want you to hire them, so they always make it sound like you're going to jail for sure, etc. etc., unless you hire someone. But during the DUI I was told that same thing, and I didn't hire a lawyer, and I didn't go to jail. I got the exact same fees and sentence as everyone else that day, several of whom did have attorneys. I need an impartial 3rd party, and I don't know anyone personally who's had this charge. I'm told that because it stems from the DUI, it's far more serious than if it had been suspended for another reason. Is this true? And if so, is it possible for me to find out who the prosecutor will be before the court date and try to work out a reduced charge, as my lawyer would do? I know it's a lot of information, and I certainly appreciate the attention if you get a minute. more

The judge called Simpson from prison, where he's serving time for armed robbery and kidnapping, to get his approval. Simpson's lawyer said his client agreed, provided that no one make money off the threads. David Cook, attorney for Goldman, says, "The donation to the Smithsonian of the acquittal suit puts front and center the shock to America when justice escaped the Los Angeles courthouse. The memory of Ron Goldman shall be on permanent display." Cook added, "If the suit is the emblematic of justice gone berserk, justice is served." LOS ANGELES (CN) - A federal class action claims that public school students in Los Angeles are denied the basic education guaranteed by the California Constitution as the district plans to lay off thousands of teachers. Due to California's budget fiasco, the state expects to send out 14,000 reduction-in-force notices to teachers this spring -- nearly 5 percent of the teaching force -- despite its rank as 46th in the nation in per-pupil spending. Students at Samuel Gompers, John H. Liechty, and Edwin Markham Middle Schools, in the city's poorest areas, with the highest concentration of minorities, were hit the hardest, according to the Superior Court complaint. Already "denied the basic educational opportunity guaranteed them by the California Constitution," according the complaint. Those schools expect to lose or already have lost 50 to 70 percent or more of their teachers. Schools in wealthier areas face far fewer layoffs. And the layoffs affect teachers who were prepared and committed to serve the poor, minority, urban students, the class claims. Such schools have a higher percentage of non-English speakers, less access to materials, and more students with learning disabilities than schools in wealthier districts. The class of students and parents say their schools had "successfully recruited a critical mass of teachers committed to staying at the schools and becoming a foundation for an experienced, effective teaching corps." But that has been demolished, the class claims. The class adds that because their schools had the highest concentration of young teachers, they were disproportionately affected by the reduction in force, which dismissed teachers with less experience first. Since layoffs began, the plaintiff students have been taught by a string of substitutes. Some students have had as many as 9 substitutes so far this school year, several of whom do not have credentials in the areas they teach - or no credentials at all, the complaint states. (Schools traditionally rotate such "permanent substitutes," as they must pay them more per day after a certain period, so disrupting students' learning saves the state money.) Many teachers who are assigned to the poor urban schools from the state's "Rehire List" quit after a few days or weeks because they are unable to keep control of classrooms, or they don't want to work in the poor areas, the class claims. "Effective instruction is not merely a matter of whether a teacher is able to teach the course content; it is also a matter of whether the teacher is able to teach that content to the students who attend that school," the complaint states. In the past 5 years, Gompers Middle School, in Watts in South Central Los Angeles, has had fewer than 15 percent of its students perform at or above proficient levels on state achievement testing, the complaint states. Markham Middle School, also in Watts, had only 13 percent of its students score as proficient. California expects to send out 14,000 reduction-in-force notices by this spring, said Ramon Cortines, Los Angeles Unified School District Superintendent. California has about 307,000 public schoolteachers. Receiving a RIF notice does not guarantee that a teacher will be laid off; many schools do not complete the hiring process until late August. But receiving a RIF notice makes teachers fear for their job and seek a new one. They become demoralized, distracted and can't focus on teaching, which exacerbates an already devastating situation, the class claims. The class sued California and the Los Angeles Unified School District, alleging violations of equal protection under the Constitution. They seek an injunction, costs and fees. I was involved in a physical altercation with my boyfriend. The police came & made a report. No arrests were made. We went our separate ways. My boyfriend & I reconciled a week after the incident. Two months later, I received a letter from the Office of the City Attorney stating that, "A complaint has been filed with this office stating you have violated Section P242, battery" & that the "matter has been scheduled for a City Attorney office hearing." I am to bring photos, witnesses..present evidence, yet will not be provided a public defender unless I am charged. Did my now ex boyfriend file this complaint? He denies that he did. Or, did the police or city file the complaint? To me the fight was mutual & I had more physical injuries than he did, yet when I call to get a police report they will not let me see it because I am "not the victim". I admitted what I did to the police, but I don't think that my ex did. I am 41, have never been in trouble & live in Los Angeles. He has been in jail three times about 10+ years ago. How likely is it that I will be charged with a misdemeanor or felony or...anything? I have been told this is a "wobbler", could be a felony or misdemeanor. I am so scared & have no money for a lawyer & other legal aid organizations will not help because this is a criminal matter & I am not the victim. Any insight, in general would help. I may have hit another car going about 1mph. Amazingly enough, I killed their bumper. I have a Yaris and they have an Acura 4x4. My car went below theirs. We decided to go around insurance. I will pay to have the bumper replaced (about $900). So, now, I think I should have them sign a waiver of some sort stating that I am not responsible for any damage claims from here out for their car or the passengers. APIn July 2009, U.S. Immigration and Customs Enforcement announced that Krispy Kreme Doughnuts Inc. agreed to pay a $40,000 fine for hiring illegal aliens. An inspection by ICE discovered Krispy Kreme hired dozens of illegal aliens at their Cincinnati, OH factory. According to the terms of the agreement, in addition to paying the fine, the doughnut maker promised to revamp their hiring process in order to hire only those authorized to work in this country. No one at Krispy Kreme was sent to prison, and the $40,000 fine, for a company that saw revenues of $384 million in 2009 alone, is downright laughable. Another 2009 investigation, discovered that 1,800 of American Apparel’s workers were illegal aliens, using fraudulent documents. The company which is located in Los Angeles is the nation’s largest clothing manufacturer, and the 1,800 illegal workers represented a third of their workforce. The owners of American Apparel have been outspoken proponents of an amnesty plan for this nation’s illegal alien population. The following is a short list of some of the more high-profile companies recently caught with illegal aliens in their employ: Agriprocessors Inc. - On May 12, 2008, ICE agents executed criminal and administrative search warrants at Agriprocessors, Inc., in Postville, IA, which resulted in the arrest of 389 illegal aliens. 305 of those arrested were also convicted of criminal offenses. CEO Sholom Rubashkin was arrested and charged with federal conspiracy of harboring illegal immigrants and aiding and abetting aggravated identity theft. However, the U.S. Attorney’s office later dropped all 72 charges against him. Pilgrim’s Pride - On April 16, 2007, ICE agents arrested 311 illegal aliens working at five Pilgrim’s Pride sites. Of the 311 arrested, 91 were charged with other criminal violations. Del Monte Produce - On June 12, 2007, ICE agents arrested 168 illegal alien employees at their Portland, OR facility. In addition to the illegal workers, 13 managers and other workers were arrested and charged with various crimes including selling Social Security cards. Swift and Company - On Dec. 12, 2006, ICE agents arrested 1,297 illegal aliens at six Swift meat processing factories in six states. 274 of those arrested were also charged with other criminal offenses. Smithfield Foods - After ICE agents raided the Tar Heel, NC plant and arrested 21 illegal alien workers, 500 workers with fake Social Security numbers were promptly fired from the factory. Another raid in August 2007, netted 28 more illegal aliens, all were from Mexico, Guatemala, and Honduras. Whether it is a landscaping company run-out of someone’s den in Cicero, IL; a 30-unit independent hotel in Virginia Beach, VA; or a corporate giant such as Tyson Foods Inc., once caught with illegal aliens in their employ, the head of that company should spend the next ten years of their life in prison. Additionally, all of that company’s profits made during the period they employed illegal aliens should be seized, with the money going directly to help pay for border enforcement. Instead of simply rounding-up the illegal workers (many of whom will not even be deported as a result), and focusing on low-level company employees for prosecution, if there is to be any…We need to begin placing leg irons on the CEOs of companies who make a practice of hiring illegal aliens. If we arrested these traitors in their walnut paneled offices, and perp-walked them into court for all to see, it would not only punish those who are truly responsible for the illegal replacement of the American worker, but send a powerful message to corporate America…Hire illegal aliens, and you will lose everything you have! We must demand that our lawmakers see to it that American companies, actually hire American workers…not invaders. Of course, those same lawmakers will first have to extract themselves from the hip pockets of many those companies. more

Illegal alien lawsuits continue to clog the courts in California February 9, 9:27 AM Well-funded illegal alien activists in Southern California have found a new way to attack Americans fighting for secure borders and enforcement of current immigration laws. The fight has moved from the streets where they wave the their Mexican flag to America's civil courtrooms. “Allow me to understand this correctly. Illegal aliens, people who have committed a crime by entering this country illegally, and who continue to commit additional crimes by using counterfeit documents to project a status they are not entitled to, are suing cities and citizens for "disrupting their RIGHT to work in the US, even though they have no such right? If any immigrant "rights" organization or other advocacy group is responsible for the filing of such suits, either directly or indirectly, they should be counter claimed against for abuse of process and malicious prosecution. It's time for the good citizens of this country to fight back through the courts,” said retired ICE Agent John Sampson who now runs CSI Consulting and Investigations. The beef about an upcoming lawsuit in San Diego against Jeff Schwilk, founder of the San Diego Minutemen, stems from a violent attack on Los Angeles anti-illegal immigration activist John Monti in November 2006 at the Rancho Penasquitos day-labor site in San Diego. “Controversial San Diego attorney Daniel Gilleon was hired by La Raza operatives more than three years ago to go after San Diego Minutemen and other pro-security activists,” says Schwilk. Monti had gone to the infamous makeshift hiring site to photograph the day laborers and the law-breaking employers hiring illegal workers. “It is still a felony to hire illegal aliens in the U.S. and studies have shown that almost all day laborers are illegal aliens from Latin America, Schwilk explains. While photographing the street-side hiring process, Monti was suddenly jumped from behind by at least seven Hispanic men. “They punched him, tried to steal his professional camera, and pushed him into the busy boulevard. Several passersby’s witnessed the attack and called 911. When police arrived two minutes later, they found a bloody and shaken Mr. Monti,” witnesses reported. Once the police were called to the scene, all of the attackers had made a run for it. Luckily, Monti photographed many of the laborers prior to the attack and was able to show San Diego Police Department. The next day the victim, Monti, sent the same pictures via email to local San Diego activists so they could call the police if the suspects returned to the day labor site where they usually look for employment every day. At this point Schwilk received the pictures and forwarded them to his local law enforcement contacts and other concerned residents in the area. Their claim was defendants were disseminating pictures of the suspects with Monti's statement and pointed out that they were wanted for questioning by SDPD regarding day-labor site scuffle. The flyer indicated if anyone had any information about the incident to phone the police. Police records show the suspects were being sought for questioning and most of them were eventually found and questioned. No charges against the suspects were ever filed, as they all, not surprisingly, claimed that Monti attacked them first. According to Schwilk, local illegal alien activists were seen speaking with the suspects soon after the attacks. “Witnesses who saw Monti being attacked and beaten were ignored by investigators and the city attorney, who were under extreme pressure from the so-called ‘Mexican mafia’ to protect the suspects (most of them Mexican citizens) from prosecution,” Schwilk contends. Fox News' and Monti's lawsuits were eventually dismissed or settled, but Schwilk demanded a trial to prove that this was just another unfounded, frivolous lawsuit and malicious prosecution meant to harass and silence those who oppose illegal immigration. This defamation suit also accuses Schwilk of putting up Monti's "wanted posters" in the area around the day labor site - a charge Schwilk denies. Schwilk and a few other concerned citizens did use Monti's pictures to identify two of the suspects standing at the sidewalk hiring area three days after the attack. "When we saw two of the suspects back at their sidewalk loitering area, we immediately called SDPD. The lead detective of the nearby division came to the scene and explained to us that they had already questioned and released those two men and that an arrest had been made," Schwilk said. “The officers refused to elaborate further, but they told us they were fully investigating the assault on Monti and hoped to bring all of the guilty day laborers to justice.” The lead attorney in this so-called lawsuit is Dan Gilleon. I have read the california renter's right law online and it shows after 21 calander days if the landlord didn't refound my "full deposit" or mail me a itemized statement that lists the amounts of any deductions from my security deposit and the reasons for the deductions, together with a refund of any amounts not deducted. Than I'm intitle to the full amount of deposit back after 21 calander days. Am i right ? I live in a city where a city council member has been indicted on 9 counts of bribery. She is currently out on bail for 250k. There is also a multimillion dollar settlement the city will be paying a builder on the other side of the bribery case. (Basically a builder bought land, and the city council member asked for a free condo and took money from this builder for bribery). There's bank accounts and phone records backing up the bribery case. ANYWAY, many people from the community want to do a recall on this city council member. We are following the recall guideline. But, we wanted to SERVE this city council member the notice of intention to recall at the city council meeting. We contacted the Los Angeles County Elections Division and asked if legally we could serve her during a meeting. We didn't want to make any mistakes and wanted to double check this. I was told that we would have to contact the city attorney in our city and get that answer from them. A call went in to the city attorney who REFUSED to give us that information. Instead we were old that our own attorney would have to give us that information and that the city attorney is hired just for the city. Why would the LA County Elections Division tell me to call the attorney then? I thought maybe different areas had different rules and this should be public information, IMO.Good idea... Resolved Question: What can I do help please?

My sister is an abused victim who has four children. She finally divorced her husband that always abused her and the children while he was in jail for one year. When the torture of the divorce was over she found a place to live with her children while on well fare but still had social services on her ass because both her and the kids were abused. Recently she was unable to pay for the water bills and social services took her children away when they found out at a surprise visit at her home. When they took the kids away my sister tried to explain to her that she was scheduled to go to my parents house the following day but they still took the kids. Now she doesn't qualify for well fare anymore and was forced to leave the house. She is currently living in a homeless shelter while still fighting for her kids with social services. The problem is the actual social worker treats her like a criminal! She calls her names and never fills out the referral that she needs for a class called domestic violence or something like that. She has to do that class according to her case plan in court. But how can she regain her children if that social worker never complies? I have spoken to the supervisor and made several consumer complaints but they are all just buddies at work I assume and aren't helping us at all! I don't have the money to hire an attorney for her, and I wish to help her but I am lost and don't know what to do anymore when even the supervisor and manager aren't listening. Every day on my drive home, I hear on NPR how my county's district attorney (Steve Cooley) wants to prosecute owners of medical marijuana dispensaries and limit the number and make them not be able to sell marijuana and I'm pissed. Why am I paying his salary? The voters in California have twice voted to allow medical marijuana. Why is he lobbying the City Council for extreme measures against the medical marijuana dispensaries. I'm not entirely sure who elects/appoints county District Attorney's. Is it at the city level (I actually live in Redondo Beach, which is not part of the city of Los Angeles, the county, or the state? I just want this guy out of office. Hi, we have some land in my dad's mom's name, which should have been passed to my dad, but my grandmother has passed away, so the land is still technically in her name. he has promised to give that land to me upon my marriage, but since we all reside in the US, we don't know how to proceed or what we can do without going to India. The next possible time to go to India would be more than one year from now. We need to know how to transfer the land to my dad's name, then to me. Lately, my boss and I have been having problems. Every since I bought my home she has been acting very funny. She did admit to me that I have something that she has always wanted...The house. I have become quite uncomfortable in my workplace. Recently, my boss came to me and told me that my Certification is not good enough and now I have to take the other exam that my co workers took. The Ohio Department of Public Safety closed the loophole after delaying a crackdown on possibly fraudulent registrations for more than a year. After The Dispatch reported on the delay, the bureau sent letters at the beginning of October to more than 47,000 people statewide whose vehicle registrations didn't list a Social Security number or Ohio driver's license or ID number. Rene Angulo was a Carson High School senior who aspired to attend college and was expecting a daughter with his high school sweetheart. He was gunned down on Mother's Day by Victor Rodriguez, 24, a gang member with a violent criminal history who had been ordered to be deported back to Mexico. Deputies said Rodriguez wanted to steal Angulo's Honda, and shot the boy while he was riding in the backseat on U.S. 395 near Bellevue Road. Authorities said that after Rodriguez shot Angulo in the back of the head and torso, he fired two shots at Wayne Nash, whose family watched in horror from inside their car. Nash was shot in the leg, his femoral artery destroyed, after he stopped to help Angulo, who was lying in the street. On Wednesday, Rodriguez told Washoe District Judge Connie Steinheimer that he wasn't in his "right mind" when he shot the men. "I want to take responsibility," he said, "but I'm not going to be up here begging for mercy. I'll do my sentence like a man." Steinheimer sentenced the father of two to the maximum term of life in prison without parole for the first-degree murder of Angulo, and the maximum of 60 years for the attempted murder with a deadly weapon of Nash. She also ordered he pay more than $63,000 in restitution, mostly for Nash's medical bills. Magaly Sanchez had been dating Angulo for five years and is pregnant with his daughter. Obama Won't Seek to Arrest Medical Pot Users - Federal Prosecutors Will Be Told It Is Not a Good Use of Their Time to Arrest People Who Use or Provide Medical Marijuana in Strict Compliance with State Laws, Officials Say AP Monday, October 19, 2009 WASHINGTON -- The Obama administration will not seek to arrest medical marijuana users and suppliers as long as they conform to state laws, under new policy guidelines to be sent to federal prosecutors Monday. Two Justice Department officials described the new policy to The Associated Press, saying prosecutors will be told it is not a good use of their time to arrest people who use or provide medical marijuana in strict compliance with state laws. The new policy is a significant departure from the Bush administration, which insisted it would continue to enforce federal anti-pot laws regardless of state codes. Fourteen states allow some use of marijuana for medical purposes: Alaska, California, Colorado, Hawaii, Maine, Maryland, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont and Washington. California is unique among those for the widespread presence of dispensaries -- businesses that sell marijuana and even advertise their services. Colorado also has several dispensaries, and Rhode Island and New Mexico are in the process of licensing providers, according to the Marijuana Policy Project, a group that promotes the decriminalization of marijuana use. Attorney General Eric Holder said in March that he wanted federal law enforcement officials to pursue those who violate both federal and state law, but it has not been clear how that goal would be put into practice. A three-page memo spelling out the policy is expected to be sent Monday to federal prosecutors in the 14 states, and also to top officials at the FBI and the Drug Enforcement Administration. The memo, the officials said, emphasizes that prosecutors have wide discretion in choosing which cases to pursue, and says it is not a good use of federal manpower to prosecute those who are without a doubt in compliance with state law. Resolved Question: How can someone find an attorney who specializes in loan modifications without being scammed?

I've already been scammed, was asked to pay a big fee upfront and told to stop making my mortgage payments only to find out their goal is to have you go into foreclosure and take over your house, they disappeared when I tried to get my money back. I'm in Los Angeles, am looking for a reputable company or attorney to help me with my loan modification!!no it's not easy with my lender, otherwise I wouldn't be willing to pay for an attorney and yes there are ligit ones out there, so don't give misinfo out plz. more

Resolved Question: my fiance left me for 6 months- now he comes back???What to do?

6 months ago my fiancé said that he was leaving to Los Angeles for training in some institute- it was against discrimination (we're both attorneys and live in Europe so when he told me I was surprised!) at first I didn’t know what to do so 2 days later I showed him the ticket I bought to go with him- I thought that it would be a nice surprise... but instead he said that I can’t go with him because he'll have a lot of work and its better if I stay and keep doing what I love... we were fighting because I didn’t understand why he was doing this to me- because of my anger i screamed out that he's probably leaving me and going back to his ex-wife (which I didn’t actually believe because they ended their relationship for good) he left and I stayed- depressed for a couple of weeks. then ran into my college boyfriend- well actually he came back from Australia and we started talking - mostly because I wanted to forget my pain... then we actually became a thing but nothing BIG happened.. but we were a couple now after over 6 months my ex-fiancé returns and knocks on my door (for 6 months he didn’t call write email- nothing) I didn’t even know if he was alive... turns out that he had lupus- and needed to go to LA for treatment because that’s where they do research on this disease,,, he didn’t want me to go with him because he didn’t want to see my pain or see me get hurt if something happened to him... I’m so mad at myself that I didn’t know this earlier! now I don’t know what to do- I love him but I don’t want to get hurt again,,, he said that he won’t apologize because what he did was for my own good... what do you think? what this sound like to an outsider???yes i called and wrote- no answer he has medications- hes in remission more
