My girlfriend has sole custody of her child. She's been divorced for about a year now but the father of the child hasn't seen the child for about 2 years now. Due to his failure to appear in court for the child custody hearing my girlfriend was awarded sole custody. Oh and she also has a restraining order (protection order) for herself and the child against the ex-spouse for the next 6 years. All of a sudden the father of the child wants visitation. Can anyone explain how this works in California (Los Angeles)? How much visitation will he get? Anyway to stop his visitation or have them monitor until the child is of age (18 years old)? Can the father of the child disrupt the childs current living status (i.e. not permit her to continue to attend the private school she current is enrolled in, not permit her to participate in her dance classes, etc.)? The child's mother resides in Los Angeles and the father has no established residence anywhere. He may try to use his sister's address in Los Angeles or his parents address in Bakersfield area. Would he be allowed to take the child to Bakersfield for any visitation he is granted? Ideally we would like there to be no visitation. But if there must be some visitation then we'd prefer it to be monitored and within the Los Angeles area, is that possible? We're afraid that the father of the child may take the child and run. He has no established residence except living with relatives and no established employment (he does not pay the court order child support). So it's hard to track his whereabouts. The divorce was very bitter and he has shown aggression in the past. If you are a Family Law Attorney, you help, answers, and any recommendations would be greatly appreciated. This will definitely tear our family apart. We've worked so hard to build a happy life for my girlfrien's daughter. Class was starting soon, and after class she had to head to work at a mall. "I'm OK now," Hall, 20, says in a telephone interview. "Sometimes it's hard to talk about it." Seven years ago, Hall was a frightened, confused and miserable 13-year-old plucked by federal authorities from a life of slavery and squalor in the unlikeliest of places: Irvine. Sold by her parents when she was 11, the Egyptian-born Hall spent nearly two years living on a bare, dirty mattress in a windowless garage on a tree-lined street of opulent, Mediterranean-style homes. There, under the noses of her neighbors on Pacific Grove in Northpark, Shyima worked 20-hour days as a domestic servant to an Egyptian couple and their five children. She was denied schooling and trips to the doctor and dentist. She was not allowed to sit down to meals with the family. She was forced to wash her own clothes by hand in a bucket. The family called her "stupid girl," and worse, instead of using her name. Now, Hall is a busy and ambitious college student who might use her difficult past as motivation to become someone special. Among the people who rescued her in April 2003 were special agents from U.S. Immigrations and Customs Enforcement. Hall hasn't forgotten them – and remembers one man in particular. Trafficking in children and adults for commercial sex and forced labor is a growing problem in Orange County. Since 2004, the Public Law Center, a founding partner of the Orange County Human Trafficking Task Force, has handled 89 trafficking cases. Right now, there are 29 open cases of forced servitude, many of which include adults or children who are much like Hall, who couldn't speak English when she was rescued. "We have open cases right now in Irvine, in Newport Beach, Crystal Cove – very wealthy communities," said Julie Greenwald, an immigration attorney for the Public Law Center. Shyima was 8 when she was sold. Having 10 other children, her parents needed the money. Her captors, a wealthy Cairo couple, relocated to Irvine. And when Shyima was 10, they hired a businessman who, in 2001, flew with her to Los Angeles, telling immigration officers that he was accompanying his "adoptive daughter" on a trip to a theme park. Shyima had no idea that her parents sold her for $30 a month for what was supposed to be 10 years. Shyima's captors took away her passport and immediately put her to work. Eventually, a neighbor noticed that the petite, dark-haired girl next door wasn't going to school like the other five children in the house. Instead, the little girl was doing chores late into the night. The neighbor made an anonymous call to authorities. Child welfare workers responded. So did ICE agents, whose work helped lead to the arrests of Abdel Nasser Youssef Ibrahim, 46, and Amal Ahmed Ewis-Abd El Motelib, 44, launching Orange County's first federal prosecution of a human-trafficking case. Ibrahim and Motelib eventually pleaded guilty to four felonies. At their sentencing in May 2006, they told the judge they thought they had not broken any laws but apologized about how Shyima was treated. Among the upper classes in some parts of Africa and the Middle East, domestic servitude is an illegal but common practice. Ibrahim was sentenced to three years in prison. Motelib got 22 months. Their children, ages 10 to 18, agreed to leave the country. Motelib has fulfilled her sentence and has been deported. Ibrahim currently is in ICE custody awaiting deportation. After her rescue, Shyima faced many challenges, in addition to not speaking English. She was behind in school. She also had a lot of pent-up anger about her ordeal. And, she was fearful of the people trying to help her – Shyima had been told that the police would do bad things to her if she went to them for help. Shyima was put into foster care, but it took three foster families until she finally felt at home. The Hall family, of Riverside County, eventually adopted Shyima, making her the eldest of their six children, who include other foster kids. Helping Shyima at every turn has been Mark Abend, an ICE supervisory special agent who spearheaded the investigation that led to the conviction of her captors. "He's like a father to me," Hall says. "We talk all the time. He's always in my life." Her connection with Abend could continue. Shyima is in her third year at Crafton Hills College in Yucaipa, studying business. But, after college, her plan isn't to get into business – it's to become an ICE agent, just like Abend. It's a highly competitive career. I recently substituted my lawyer out and am currently representing myself in Los Angeles Superior Court, CA. This is a child custody matter. I emailed the opposing counsel today requesting he get back to me next Friday with respondent's selection of one of the new pediatricans I proposed in that same email. Opposing counsel responded saying, "This is something you can deal directly with respondent about." Isn't opposing counsel required to treat me like I am an attorney and respond to my requests? If so, what is the best way to get the lawyer to do his job? more

Resolved Question: Child Custody Q About Home Life (PSYCHOLOGY PSYCHIATRY Q)?

My son lives with his mother right now but I found out he is failing school last 2 years, and she never told me. He has severe behavioral problems/ and social skills. Long story short mother never helps him on homework, let's him play World of Warcraft for 4-5 hours each day 7 days of week while she goes upstairs with her lover and locks the door. MY KID is 7 years old and will repeat first grade. He told me he was slapped a few times by mother's lover and I reported it to CPS. NOW, my Q is my attorney said I or my ex-girlfriend cannot get a counselor or psychiatrist to examine my child in depth about his home life, because it would be biased. They said it would have to be a state appointed psychiatrist or psychologist. I want him analyzed now, because the mother is brainwahsing him that I'm trying to take him away and mother is making my kid cry, and he has severe panic attacks at school, and disturbs other students. Resolved Question: How to file for joint custody in CA without an attorney?

A friend of mine was dating a girl for a significant period of time, she disappeared out of his life suddenly and popped back in when she was five months pregnant. The baby was born about a week ago. My friend is kind of in shock but he wants to act immediately to find out if the child is his so that he can become an active father and support his child as well as have a relationship with the baby. The mother of the child claims the baby may not be his but she thinks it's his... I really want to help my friend out because he is a real good guy. Based on these circumstances how can we go about determining paternity through the courts as well as filing for joint custody if the baby is his? We want to act as fast as possible, she is not letting him see the baby only through pictures and he doesn't want to waste any time so that he can begin bonding with the baby and doing whats right. This is his first child. *Note: He already tried to convince the mother to voluntarily agree to have a paternity test done but she is giving him the run around and stringing him along. We initially were gonna just do that and if the child was his we were going to go through the courts from that point forward. Resolved Question: I pay child support, Jurisdicition in California. I reside in Nevada & he left for Spring, TX w/o court order

My Ex filed a fraudulent Child Support issue, claiming I haven't paid child support since 1997. I have copies of signatures for sending money orders, cancelled checks. The State of Texas sent papers of a child's name that is not mine,proven by birth certificate. My Child Custody/Support case in California. I reside in Nevada. He left without Judicial consent to remove minor from the state of California. I have already had to file an-EX-Parte case in order to have a valid physical address to continue to send child support to. Information not provided, found by his new wifes' housing tax roles. How can I prove myself to the State of Texas that I do not owe a sum of $15,407.00 in back child support? Thus far I have attempted to reach the DA of Los Angeles, CA advised that I need a Judge's Order before they will speak to me. State of Nevada tells me, California case. Prince Frederic Von Anhalt, husband of Zsa Zsa Gabor, announced today that he would be filing a paternity challenge to gain custody of Dannielynn, according to the Associated Press. The Prince says he met with attorney Gloria Allred about the case, and that the affair has "deeply upset" the 90-year-old Gabor. "She definitely doesn't want a child in the house," says Von Anhalt of Zsa Zsa. But sources tell TMZ that Von Anhalt is actually on the payroll of certain European tabloids, feeding them stories, and, in fact, that he created this entire scenario for them. "He timed it to coincide with the arrival in Los Angeles of hundreds of foreign media outlets for Oscar junkets," says our source. Reps for Von Anhalt and Gabor could not be reached for comment. I'm a male 46 years old living near Los Angeles. My former spouse will "stop at nothing" to have things always go her way. I have had to endure her abusive nature and have felt the effects of her torment for so long I am at the point of total immobilization. I want what is reasonable. I want to be able to visit my 3 children and have some say so in how they are being raised. She has sole legal and physical custody and can afford her own attorney. I have downloaded the forms but I feel so helplessly alone in this matter and with a sense of doom I just can't seem to muster up what it takes to get the job done. I just feel shame and dread and my children need me and they are being forbid to see or contact me. Can anybody help me, I'm desperate. I need some sort of support network, a personal coach or just someone who can lend their expertease to this situation.
