I was charged with a DUI and accident no one was hurt. I had to hire an attorney because the DA that took my case was real though on my case. He order me to do county jail time 180 plus 180 day consecutive plus a Re-hap inpatient program which I don't do drugs and that was my first DUI plus AA program for 3 months. I was sentenced and had to turn my self in that day at court. I was sent to Los Angeles county jail and 5 days later I was called for work release program, I took it because I had just gave birth with a c section 22 days before I was sentenced and arrested, I became pregnant of my newborn 2 weeks after I had the accident and DUI. Thru out my pregnancy I was going to pretrail. because of one wrong choice I went thru all of this , but anyways I have be doing my work release everyday, I enrolled to the AA program aswell. I tryed enrolling to the program but the admission said I don't qualify because one its been almost a year since I took that one drink, two they can't take me apart from my newborn, and medical condition of c section the lady who assist me said if they had any question to call her directly. I went to my restitution hearing today and the DA is upset because they let me out early. He asked the judge to detain me again!! The judge said he can't do that because the department of sheriff is a different department, and they are going to do an investigation, so they order me to go back to court tomorrow. To be honest I am very worried of what the worst. I would like to know if the DA asks the judge for me to be detained can the judge order me to be remained. I mean I have been doing everything that they asked me to do. I would'nt be able to take another if they would to do an unreasonable decision? I believe they have done so much already.. more

Ok so my ex and my daughter moved out of their old house because my ex could not afford living there, well my parents decided to help her untill she had enough for a deposit to get an apartment. This was back in August of 2009, a year ago basically. My parents do not charge her a dime of rent and she doesn't even have to pay for food. Also, my daughter has a babysitter that cooks and cleans that the my ex does not pay for either, my parents do. Well, because of all my parents were doing for my ex and my daughter, we all agreed that I should not pay child support anymore because she was had everything she needed. Its a year already, with a couple months my ex gets moved with my parents, she gets a DUI, her chances of getting an apartment are ZERO. So she's been driving with a suspended license. Just recently, she decides that she wants to move out of town and she raving on how I have not been paying child support and that she's going to open a case against me and make me drive 2 hours to pick my daughter and 2 hours back to bring my daughter with me, which I know will be discounted from the child support she receives. My ex says her bestfriends parents have a room for her and all she needs to do is pay for groceries, utilities, and babysitting. She has yet to get a job out there and she only works 15 hours a week here. Most of her money goes to her tattoo artist and she skips work to go fill out applications in the new town she wants to live in. Really all this is about my ex going on a rampage because I just got an apartment with my fiance. My ex told my mom that the only way she would stay is if I get back together with her, which I think is hilarious because its been 2 years since we've separated. We never married btw... My question is how bad can she screw me over with child support? I mean I only make $1600 a month, I'm in Los Angeles County, and she wants to move to Tulare County, i dont know if that is of any relevance. Also, I pick up my daughter every Saturday afternoon and I drop her off the next afternoon. I'm just wondering what I should do to defend myself, I am clueless. I can't afford an attorney. more

I recently got booked for a DUI in Los Angeles. My breathalyzer tests registered me at .16 and .13 (roadside and at the station, respectively). I've already set up a DMV hearing for myself and put a stay of suspension on my driver's license, but I have yet to hire an attorney. I've consulted with many, but so far I've mostly gotten the same blanket reassurances from all of them, along with tips and information about the legal system that are downright contradictory with one another (e.g., some have told me the best plea bargains come at the first hearing, while others tell me the best deals come at later hearings). Is it worth it to hire an attorney? And, if I do, should I hire one before my arraignment hearing, or wait until after it, at which time I would have a copy of the police report and all the evidence compiled against me? Thanks in advance!Basically, I'm wondering if I'll get a clearer, more straightforward assessment of my case from a potential attorney if I wait until I have a police report/compiled evidence to present to him/herSo, everytime I consult a new lawyer, he/she ends up telling me, "the results depend on the facts of the case, every one is different. Hire me now, and I'll be able to tell you more after I get all the evidence/paperwork". That's why I'm asking whether I should wait until I get the paperwork myself (at my arraignment) before hiring a lawyer, so that I can get a more concrete answer as to the possibilities of my case. more

misdemeanor 14601A suspended license charge, in Los Angeles. The main difference in my case being that mine was suspended due to a brief lapse in insurance, (automatically suspended upon the lapse, due to a DUI conviction in Sept. 2008, my first offence ever). What I really want to know is, is it worth hiring an attorney for this? I've spoken to several, but the problem is, attorneys want you to hire them, so they always make it sound like you're going to jail for sure, etc. etc., unless you hire someone. But during the DUI I was told that same thing, and I didn't hire a lawyer, and I didn't go to jail. I got the exact same fees and sentence as everyone else that day, several of whom did have attorneys. I need an impartial 3rd party, and I don't know anyone personally who's had this charge. I'm told that because it stems from the DUI, it's far more serious than if it had been suspended for another reason. Is this true? And if so, is it possible for me to find out who the prosecutor will be before the court date and try to work out a reduced charge, as my lawyer would do? I know it's a lot of information, and I certainly appreciate the attention if you get a minute. more

Recently, I was pulled over and received a DUI. At the scence, I took the field sobriety test and blew a 0.087% but when I got to the station, I only blew a 0.07% (30 min. apart). Police roadblocks to remove unlicensed drivers challenged From wire service reports A controversial police technique to remove unlicensed drivers from the roads is being challenged on civil rights grounds, and another federal court decision is expected soon, it was reported today. Police across California are using temporary roadblocks to find unlicensed drivers, and impound their cars. But Latino rights groups say that practice is discriminatory and aimed at undocumented workers, who are unable to pay for their cars' steep impound fees. Los Angeles and Orange counties have joined several other agencies in supporting a state law that requires cars driven by unlicensed or uninsured motorists to be impounded on the spot, and towed to a storage yard. Three civil rights law firms have sued several agencies, including the City of Los Angeles, for impounding cars owned by illegal aliens, who are barred by state law from getting drivers licenses. The suit claims that Latinos are being singled out in an unconstitutional, sweeping move that violates constitutional protections against unreasonable police conduct against all persons, not just U.S. citizens. ``We've heard a lot of complaints from the Latino community,'' said Bill Flores, a San Diego County Latino organizer, in an interview with the Oceanside North County Times. He noted that the impound fees of $1,500 must be added to towing and administrative fees that can go above another $400. The groups argue that the cars should be parked safely and the motorists cited, so the cases can be heard in court. Some licensed drivers have lost their cars when they could not find their insurance documents at the roadblocks, or if they lent the car to an unlicensed driver, and could not afford to get them out of impound. City News Service MISSION VIEJO – Former Vice President Al Gore's son faced drug charges today in Orange County as his father faced the media while preparing for an international music festival to highlight global warming. Al Gore III, 24, a Los Angeles resident, was driving a blue Toyota Prius south on the San Diego (5) Freeway about 2:15 a.m. yesterday when a sheriff's deputy stopped him at the Crown Valley Parkway exit for speeding, said sheriff's spokesman Jim Amormino.
