Los Angeles - An illegal immigrant gang member charged with murdering a standout Los Angeles High School football player had his motion for a change of venue denied today. Pedro Espinoza, 20, is accused of shooting 17-year-old Jamiel Shaw Jr. about 8:30 p.m. March 2, 2008, in the 2100 block of Fifth Avenue, while he was talking with his girlfriend on the phone two doors from his home. Prosecutors said they will seek the death sentence if he is convicted. Espinoza's attorneys, Csaba Palfi and David Houchin, had asked Los Angeles Superior Court Judge Bob Bowers Jr. to allow the trial to be moved outside Los Angeles County because of extensive pretrial publicity. Palfi said the judge denied the motion without prejudice, which allows the defense to renew its motion. "It is without question that this homicide shocked the Los Angeles community when it occurred and has been given, and will continue to be given, pervasive attention in this county from which all prospective jurors will be drawn," the attorneys wrote in their change-of-venue motion. "Media coverage has been both sensational and inflammatory." The defense wanted the trial moved to Santa Barbara County where, Palfi said, "the publicity wouldn't be as great." Straight person asking stupid question here. When my husband and I got married I took his name. I knew I was the wife because I had girl parts and I knew he was the husband because he had guy parts. I guess straight people don't have a whole lot to sort out. Apparently Ellen is the "husband" in this relationship as she gave Portia an engagement ring and Portia is taking her name. I understand that someone is born a lesbian but is it a conscious choice to be the husband or wife in a relationship?By saying "husband" I meant Ellen literally wears the pants in the family and I didn't know that there aren't specific gender roles in a lesbian marriage. Conviction could result in up to three years in prison. A Los Angeles County Superior Court judge on Wednesday threw out a lawsuit by the parents of a high school football star who had sued the Sheriff’s Department for releasing from jail an illegal immigrant suspected of killing their son. 'The parents of Jamiel Shaw II, a running back who was recruited by Stanford and Rutgers universities before he was gunned down in 2008, had accused the sheriff of negligence, wrongful death and civil rights violations for letting Pedro Espinoza out onto the streets instead of turning him over to immigration authorities. Espinoza, a 21-year-old who prosecutors say was a member of the 18th Street gang in the United States illegally, had been released from jail a day before the shooting after serving time for an earlier offense. His criminal case, in which he faces the death penalty, remains pending. Shaw’s family alleged in their suit that because of an agreement allowing local agencies to enforce federal immigration law, the Sheriff’s Department was liable for Shaw’s death. At the time of the suit’s filing, immigration law experts said the argument that a sheriff or warden could be held liable for releasing an illegal immigrant who goes on to commit a crime was unprecedented. In dismissing the suit Wednesday, Judge Charles F. I am in California and I received a fix it ticket for my license plates and a non correctable citation for my tinted windows. I got both fixed and signed off by the CHP and I mailed the ticket along with the courtesy note I received stating I owed 199.00 to the Metropolitan Court house. A couple days ago I went to look at the status of the ticket on the Los Angeles Superior Court website and it shows that the case is closed and the disposition says : Bail Forfeiture. I'm 17 about to be 18 in 3 weeks. I went to the DMV today to take the written test to get my permit. Well, I was stopped dead in my tracks and all the excitement left my body immediately as soon as the DMV lady handed everything back and said some stuff about me having to go to court. Well, I guess I have an unpaid ticket from october 2006 for curfew, and I can't get a permit or license until I take care of this....BUT, I NEED TO DRIVE BY MAY...NEXT MONTH. My dad is going to get back surgery and won't be able to drive, so I have to.....So, I called the court and kept getting an automated answering machine and they pretty much told me that I have to go there and pick up a mail-in correspondence form and send it to them through mail with my i.d. and birth certifacte copy and they will "get back to me"......I don't have time. I need to take care of this now. But i guess since this ticket was from 4 years ago, they said something about a mail-in correspondence procedure...I have no idea what this is though.....WHAT DO I DO?? Lopez faces voter fraud charges that he registered to vote in Los Angeles while living in Santa Ana. On Feb. 3, he was ordered to have a competency hearing after he fired his attorney and repeatedly told the court that he was not the defendant. The competency hearing began yesterday. “He refused to identify himself,” Deputy District Attorney Juliet Schmidt wrote me in an email. “Apparently there was a ruckus. I wasn’t there. The judge held him in contempt and he was remanded into custody.” The hearing was continued today and Superior Court Judge Maria Stratton determined Lopez competent to stand trial, according to district attorney spokeswoman Jane Robison. Lopez was released from jail on his own recognizance. A scheduling hearing will be held Monday to set the date of his preliminary hearing. Late Thursday night, the Mexican American Political Association, sent out an email, saying, “He is being held with the most dangerous prisoners and was forced to get naked and watched and video taped by three female guards. He has decided to begin a hunger strike. We need your help and support during this moment and need help spreading the word. Please notify any media and come out and show your support. This is extremely unjust and we must get him out of prison and make everyone aware of what is going on…. Lopez is national president of Mexican American Political Association and national director of Hermandad Mexicana Latinoamericana, both of which are advocates for immigrant rights. A controversial figure among both anti-illegal immigration activists and some community activists, Lopez was recalled in 2003 from his post as school board member after serving six years. The charges against him were filed after Bowen’s office investigated a tip and turned the matter over to the Los Angeles District Attorney’s Office to prosecute. The office where he was registered to vote was the Boyle Heights branch of Hermandad Mexicana Latinoamericana, according to Bowen. The Orange County Registrar of Voters said Lopez had been registered to vote in Santa Ana until January 2008, when he cancelled his Orange County registration. Lopez surrendered to authorities on Wednesday. Superior Court Commissioner Alan Rubin granted Lopez’s request to be released without posting bail. The Los Angeles District Attorney’s Office had been seeking bail of $55,000, said spokeswoman Sandi Gibbons. I recently substituted my lawyer out and am currently representing myself in Los Angeles Superior Court, CA. This is a child custody matter. I emailed the opposing counsel today requesting he get back to me next Friday with respondent's selection of one of the new pediatricans I proposed in that same email. Opposing counsel responded saying, "This is something you can deal directly with respondent about." Isn't opposing counsel required to treat me like I am an attorney and respond to my requests? I don't know about your area, but in the Los Angeles area, the Superior Court is way to desperate. I know someone who doesn't even qualify, but they send her another summon (she was denied) forcing her to go. She doesn't understand English well enough to be a juror. She's to slow to comprehend what will be said at a trial, I know. But I don't think they care. Just think if you ever have to go to court, and your life is on the line, these are the kind of people they select for jury duty. LOS ANGELES (CN) - A federal class action claims that public school students in Los Angeles are denied the basic education guaranteed by the California Constitution as the district plans to lay off thousands of teachers. Due to California's budget fiasco, the state expects to send out 14,000 reduction-in-force notices to teachers this spring -- nearly 5 percent of the teaching force -- despite its rank as 46th in the nation in per-pupil spending. Students at Samuel Gompers, John H. Liechty, and Edwin Markham Middle Schools, in the city's poorest areas, with the highest concentration of minorities, were hit the hardest, according to the Superior Court complaint. Already "denied the basic educational opportunity guaranteed them by the California Constitution," according the complaint. Those schools expect to lose or already have lost 50 to 70 percent or more of their teachers. Schools in wealthier areas face far fewer layoffs. And the layoffs affect teachers who were prepared and committed to serve the poor, minority, urban students, the class claims. Such schools have a higher percentage of non-English speakers, less access to materials, and more students with learning disabilities than schools in wealthier districts. The class of students and parents say their schools had "successfully recruited a critical mass of teachers committed to staying at the schools and becoming a foundation for an experienced, effective teaching corps." But that has been demolished, the class claims. The class adds that because their schools had the highest concentration of young teachers, they were disproportionately affected by the reduction in force, which dismissed teachers with less experience first. Since layoffs began, the plaintiff students have been taught by a string of substitutes. Some students have had as many as 9 substitutes so far this school year, several of whom do not have credentials in the areas they teach - or no credentials at all, the complaint states. (Schools traditionally rotate such "permanent substitutes," as they must pay them more per day after a certain period, so disrupting students' learning saves the state money.) Many teachers who are assigned to the poor urban schools from the state's "Rehire List" quit after a few days or weeks because they are unable to keep control of classrooms, or they don't want to work in the poor areas, the class claims. "Effective instruction is not merely a matter of whether a teacher is able to teach the course content; it is also a matter of whether the teacher is able to teach that content to the students who attend that school," the complaint states. In the past 5 years, Gompers Middle School, in Watts in South Central Los Angeles, has had fewer than 15 percent of its students perform at or above proficient levels on state achievement testing, the complaint states. Markham Middle School, also in Watts, had only 13 percent of its students score as proficient. California expects to send out 14,000 reduction-in-force notices by this spring, said Ramon Cortines, Los Angeles Unified School District Superintendent. California has about 307,000 public schoolteachers. Receiving a RIF notice does not guarantee that a teacher will be laid off; many schools do not complete the hiring process until late August. But receiving a RIF notice makes teachers fear for their job and seek a new one. They become demoralized, distracted and can't focus on teaching, which exacerbates an already devastating situation, the class claims. The class sued California and the Los Angeles Unified School District, alleging violations of equal protection under the Constitution. They seek an injunction, costs and fees. My friend lives in Los Angeles, California. She's currently doing a job that takes her all over the U.S. and she will not be back in California because she's moving to New York when her job is finished at the end of Feburay. Anyway, while she's doing her job she changed her address to her sisters house. Her sister called her today saying she got something in the mail from the california superior court saying she owes 700 bucks (for some type of traffic ticket, either speeding or parking) and didn't show up for her court date. However, she never received anything in the mail prior to this one letter and has NEVER been pulled over and given a speeding ticket. I do know that you can get speeding tickets without being pulled over through the camers. So, my question is: what should she do? She tried calling to figure out what's going on and what the ticket is for but obviously it's the holidays. She's moving to New York and giving her car to her parents, so what would happen if she never paid the ticket from California? Ok I still have the actual ticket with me. This ticket was for speeding about a month and a half ago in late September by the California Highway Patrol. I searched by both ticket number and license and still nothing. I also called the machine and got nothing either as well as no courtesy notice. A Window Into Ticket Scalping Lawsuit Claims Ticketmaster Sold Tickets at Markups to Face Value Ticketmaster Entertainment Inc. and its current chief executive paid a ticket broker to sell tickets at more than their normal face values to concerts by the Eagles, Journey and other acts, according to a lawsuit the broker has filed against the ticketing giant. While the underlying lawsuit is a breach-of-contract allegation, the alleged events it describes highlight the broader importance of ticket reselling for the concert industry. A planned merger by Ticketmaster and concert promoter Live Nation Inc. is based in large part on giving them greater control over ticket prices, allowing the companies to compete more effectively against ticket brokers. Executives at the companies have said they see no benefit from scalping, as ticket reselling is commonly known. But the arrangement described in the lawsuit, if true, would be one of several recent examples of ways the companies have found to do just that. Many brokers complain that a tie-up of Ticketmaster and Live Nation would put them out of business because the higher prices the merged company could charge would leave little room for broker markups. "This is a meritless lawsuit which we will defend with vigor," a Ticketmaster spokesman wrote in an email, declining further comment. On May 21st, I received a ticket for not properly stopping at a stop sign. I waited the appropriate 21 days before trying to process my ticket. which fans are better, which fans are worse. i've lived in both LA and FL and am an avid basketball fan therefore i believe i know everything there is to know about both teams statistically and intellectually. i always try to attempt not to hold a bias when i analyze. BUT, i am a magic fan and i happen to believe that the magic are far superior. i understand because of a lopsided game 1 loss laker fans will talk and talk and talk but i justify that talking to an unawareness that they have of the magic. with that said i was just wondering since i seem to have my head up my behind like many other magic fans who believed we would make it all the way and who believe our team has the most depth from top to bottom...i was wondering if that suggests we might be worse off than laker fans who seem to act similarly albeit without real knowledge about their opposition, which i credit magic fans for having. if i was asked this question i would believe that magic fans are better because the home court advantage is far more favorable. amway arena has the whiteout with every fan wearing the shirts and a spirited crowd that is not as vibrant at staples center. The relatives also are alleging negligence, violation of the Immigration and Nationality Act and deprivation of civil rights. They are seeking unspecified damages. Shaw, a Los Angeles High School football player, was shot and killed in March 2008, allegedly by Espinoza, an alleged gang member who was in the country illegally. According to the lawsuit, deputies negligently released Espinoza from jail on March 1, 2008, despite knowing he was "a dangerous felon and an immigration violator."
