This is a fact-pattern: Mr. Smith has moved to Toronto. He is part of a new religious group that has recently been founded in Los Angeles. This group was founded in response to the celebrity culture of southern California government identification cards. They also believe that being photographed is corrupting and will therefore not consent being photographed under any circumstances. As part of his legitimately held religious beliefs, Mr. Smith has challenged the requirement that he be photographed and carry a driver's license in order to drive his car. The Ontario Superior Court has agreed that the requirement of a picture is an unconstitutional violation of his religious freedom, but has held that the requirement that he carry his driver's license with him to drive is not. Both parties are cross-appealing this decision. I am siding with the Ontario Superior Court's decision about Mr. Smith needing a driver's license to drive regardless of his religious aspects. LOS ANGELES (CN) - A federal class action claims that public school students in Los Angeles are denied the basic education guaranteed by the California Constitution as the district plans to lay off thousands of teachers. Due to California's budget fiasco, the state expects to send out 14,000 reduction-in-force notices to teachers this spring -- nearly 5 percent of the teaching force -- despite its rank as 46th in the nation in per-pupil spending. Students at Samuel Gompers, John H. Liechty, and Edwin Markham Middle Schools, in the city's poorest areas, with the highest concentration of minorities, were hit the hardest, according to the Superior Court complaint. Already "denied the basic educational opportunity guaranteed them by the California Constitution," according the complaint. Those schools expect to lose or already have lost 50 to 70 percent or more of their teachers. Schools in wealthier areas face far fewer layoffs. And the layoffs affect teachers who were prepared and committed to serve the poor, minority, urban students, the class claims. Such schools have a higher percentage of non-English speakers, less access to materials, and more students with learning disabilities than schools in wealthier districts. The class of students and parents say their schools had "successfully recruited a critical mass of teachers committed to staying at the schools and becoming a foundation for an experienced, effective teaching corps." But that has been demolished, the class claims. The class adds that because their schools had the highest concentration of young teachers, they were disproportionately affected by the reduction in force, which dismissed teachers with less experience first. Since layoffs began, the plaintiff students have been taught by a string of substitutes. Some students have had as many as 9 substitutes so far this school year, several of whom do not have credentials in the areas they teach - or no credentials at all, the complaint states. (Schools traditionally rotate such "permanent substitutes," as they must pay them more per day after a certain period, so disrupting students' learning saves the state money.) Many teachers who are assigned to the poor urban schools from the state's "Rehire List" quit after a few days or weeks because they are unable to keep control of classrooms, or they don't want to work in the poor areas, the class claims. "Effective instruction is not merely a matter of whether a teacher is able to teach the course content; it is also a matter of whether the teacher is able to teach that content to the students who attend that school," the complaint states. In the past 5 years, Gompers Middle School, in Watts in South Central Los Angeles, has had fewer than 15 percent of its students perform at or above proficient levels on state achievement testing, the complaint states. Markham Middle School, also in Watts, had only 13 percent of its students score as proficient. California expects to send out 14,000 reduction-in-force notices by this spring, said Ramon Cortines, Los Angeles Unified School District Superintendent. California has about 307,000 public schoolteachers. Receiving a RIF notice does not guarantee that a teacher will be laid off; many schools do not complete the hiring process until late August. But receiving a RIF notice makes teachers fear for their job and seek a new one. They become demoralized, distracted and can't focus on teaching, which exacerbates an already devastating situation, the class claims. My friend lives in Los Angeles, California. She's currently doing a job that takes her all over the U.S. and she will not be back in California because she's moving to New York when her job is finished at the end of Feburay. Anyway, while she's doing her job she changed her address to her sisters house. Her sister called her today saying she got something in the mail from the california superior court saying she owes 700 bucks (for some type of traffic ticket, either speeding or parking) and didn't show up for her court date. However, she never received anything in the mail prior to this one letter and has NEVER been pulled over and given a speeding ticket. I do know that you can get speeding tickets without being pulled over through the camers. So, my question is: what should she do? She tried calling to figure out what's going on and what the ticket is for but obviously it's the holidays. She's moving to New York and giving her car to her parents, so what would happen if she never paid the ticket from California? Ok I still have the actual ticket with me. This ticket was for speeding about a month and a half ago in late September by the California Highway Patrol. Well the court date is schedule for 12/08/09 but I rather just pay off the ticket online. The thing is their is no record of my ticket at all on the Los Angeles Superior Court Website. I searched by both ticket number and license and still nothing. I also called the machine and got nothing either as well as no courtesy notice. SACRAMENTO, Calif. – Gov. Arnold Schwarzenegger is calling out his wife, Maria Shriver, for apparently violating a state law he signed — holding her cell phone while driving. The celebrity Web site TMZ.com posted two photographs Tuesday showing Shriver holding a phone to her ear while she's behind the wheel. It says one was snapped Sunday and the other in July. The Web site later added a video it said was shot Tuesday in Brentwood, where the family lives. It shows Shriver holding a cell phone to her ear while driving a large SUV that appears to be a Cadillac Escalade. She then puts the phone down while the camera is rolling. The first lady's office said it would have no comment. On his Twitter feed, Schwarzenegger wrote to TMZ.com founder Harvey Levin: "Thanks for bringing her violations to my attention. There's going to be swift action." Schwarzenegger spokesman Aaron McLear says that by "swift action," the governor means he'll ask his wife not to hold the phone while driving. A law that took effect in July 2008 requires California drivers to use a handsfree device when talking on cell phones. A Window Into Ticket Scalping Lawsuit Claims Ticketmaster Sold Tickets at Markups to Face Value Ticketmaster Entertainment Inc. and its current chief executive paid a ticket broker to sell tickets at more than their normal face values to concerts by the Eagles, Journey and other acts, according to a lawsuit the broker has filed against the ticketing giant. While the underlying lawsuit is a breach-of-contract allegation, the alleged events it describes highlight the broader importance of ticket reselling for the concert industry. A planned merger by Ticketmaster and concert promoter Live Nation Inc. is based in large part on giving them greater control over ticket prices, allowing the companies to compete more effectively against ticket brokers. Executives at the companies have said they see no benefit from scalping, as ticket reselling is commonly known. But the arrangement described in the lawsuit, if true, would be one of several recent examples of ways the companies have found to do just that. Many brokers complain that a tie-up of Ticketmaster and Live Nation would put them out of business because the higher prices the merged company could charge would leave little room for broker markups. "This is a meritless lawsuit which we will defend with vigor," a Ticketmaster spokesman wrote in an email, declining further comment. The lawsuit was filed last week in Los Angeles Superior Court by Chuck Lombardo, a ticket broker in the New York area who alleges that Ticketmaster reneged on an agreement to buy his company and give him a three-year employment contract. Ticketmaster last year hired Mr. Lombardo and his company, Elite Entertainment Inc., as consultants when Ticketmaster was building a presence in the secondary ticketing market, according to the suit. The alleged events described in the suit took place nearly a year after the collapse of separate talks, with the code name Project Showtime, that would have led to Ticketmaster acquiring six regional brokerages, including Elite. Ticketmaster also routinely sells premium-priced tickets on its Ticketexchange.com site, which had been billed as a place for fans to sell tickets to one another. Mr. Lombardo in his suit says his duties for Ticketmaster in 2008 included selling "premium tickets," essentially prime seats at higher than normal face value, for concert tours by high-profile artists, including Journey, Van Halen and other artists. People in the concert industry have said acts typically would benefit from such arrangements. Mr. Lombardo's suit says Ticketmaster agreed to pay him 6% of gross ticket sales. In one instance, Mr. Lombardo alleges that talentmanagement company Front Line Management sold him tickets to concerts by one of its clients, the Eagles, for above their face value. Mr. Lombardo then resold the tickets for more still and shared the difference with Front Line, he says. Ticketmaster bought Front Line last October and made its chief executive, Irving Azoff, CEO of the combined company. A representative for Journey, Van Halen and the Eagles said the bands were unavailable for comment. Mr. Lombardo's lawsuit comes as historically strained relations between Ticketmaster and brokers have reached a new level of tension. In addition to their complaints about the planned merger, brokers have complained about Ticketmaster's introduction of electronic tickets, which customers can pick up only at a box office shortly before an event and are nearly impossible to resell except in limited circumstances controlled by Ticketmaster. The company says the practice helps ensure that fans have access to tickets at the original sale price. Mr. Lombardo in his suit says Ticketmaster last October proposed acquiring his company and hiring him. But soon after and without explanation, he says, Ticketmaster withdrew the offer and began pressuring him to accept less money than he believed he was owed for the work he had done. On May 21st, I received a ticket for not properly stopping at a stop sign. I waited the appropriate 21 days before trying to process my ticket. I called the Los Angeles Superior Courts Traffic and Information line, and when I plugged in my citation number, and my license number, my ticket couldn't be found. What do I do? Should I go to court anyway? My ticket said I have to appear in court on or before the 25th of June, and I was hoping to contest it. Brown's lawyer Mark Geragos announced that a deal had been struck just minutes before a preliminary hearing was set to start in a Los Angeles courtroom. Brown, who could have faced four years in prison for felony charges of assault and making criminal threats, will not serve any jail time. Instead, he was sentenced to five years probation and 1400 hours of community service, which he may be allowed to serve in his home state of Virginia. If Brown violates his probation, he will be ordered to serve the maximum four years. Los Angeles Superior Court Judge Patricia Schnegg also issued a protective stay-away order, under which Brown cannot come within 50 yards of Rihanna unless they are required to be at the same event, in which he case, he cannot come within 10 yards of her. which fans are better, which fans are worse. i've lived in both LA and FL and am an avid basketball fan therefore i believe i know everything there is to know about both teams statistically and intellectually. i always try to attempt not to hold a bias when i analyze. BUT, i am a magic fan and i happen to believe that the magic are far superior. i understand because of a lopsided game 1 loss laker fans will talk and talk and talk but i justify that talking to an unawareness that they have of the magic. with that said i was just wondering since i seem to have my head up my behind like many other magic fans who believed we would make it all the way and who believe our team has the most depth from top to bottom...i was wondering if that suggests we might be worse off than laker fans who seem to act similarly albeit without real knowledge about their opposition, which i credit magic fans for having. if i was asked this question i would believe that magic fans are better because the home court advantage is far more favorable. amway arena has the whiteout with every fan wearing the shirts and a spirited crowd that is not as vibrant at staples center. And of course referring back to game 1 i realize because of the outcome there people will just ignore any attempts i am making to suggest the magic are the better team here, however it is worth noting the magic have still won 2 out of 3 against the lakers this season regardless of whether they were playoff or non-playoff games. finally, because i brought up the home court issue and how the lakers still technically own home court advantage i will offer up my predictions for the outcome of this series. As Kobe said following the game 1 victory, the Magic had an off day (in fact the worst game i have seen them play all season) and they will come to play in game 2. Hello, I have been dating a man for the last year. For the last few months his behavior became inconsistent and erratic, despite an angel face and a very calm demeanor. After loosing his job he has made up all sort of excuses to not look for another one. Shaw, a Los Angeles High School football player, was shot and killed in March 2008, allegedly by Espinoza, an alleged gang member who was in the country illegally. Shaw was shot at 8:30 p.m. a day later in the 2100 block of 5th Avenue while talking with his girlfriend on the phone two doors from his home. A Torrance law firm has once again emerged the victor in a protracted court battle with pop star Michael Jackson over unpaid legal fees. The 2 nd District Court of Appeal issued an opinion Monday favoring Ayscough & Marar, which represented Jackson on various civil matters around the time he was on trial for child molestation in 2005. However, Jackson beat it before paying the $217,000 bill. Ayscough & Marar sued Jackson and two of his companies in Torrance Superior Court. Just as the case was to go to trial before a downtown Los Angeles judge in June 2007, Jackson agreed to pay what he owed, plus interest. Then, Jackson appealed, claiming Judge James Chalfant wrongly denied his quest to postpone the trial. "It made no sense," Brent Ayscough said in a telephone interview Tuesday. "How do you appeal something you agreed to pay?" A message left for Jackson's attorney, Thomas Mundell, was not immediately returned. In addition to the legal fees, Jackson also agreed to pay $175,000 to cover Ayscough & Marar's expenses for suing Jackson, Ayscough said. At the time of Jackson's appeal, he had paid the firm approximately $440,000. Ayscough said they will likely file a motion to recoup the costs of fighting the appeal, too. Ayscough said that his firm was hired through Jackson's brother and then business manager, Randy Jackson - who remains a longtime client of the firm. Ayscough & Marar fought mostly successfully to keep the information related to the criminal case out of the media, and also dealt with other civil cases. Once case was brought by Jackson's former business associate, porn producer F. Marc Schaffel, over more than $1.4 million in unpaid royalties and loans from various collaborations. At first, the legally embattled King of Pop paid his bills. Then, he stopped. "I said, 'If you don't pay us, we're gonna quit,'" Ayscough said. The firm sued in February 2006 and Jackson countersued, claiming his former lawyers wrongly threatened to reveal information related to the criminal trial if he didn't pay. Chalfant dismissed the cross complaint. Ayscough & Marar won a court ruling that ordered Jackson to participate in a deposition. He went, but then, inexplicably, left before it was over. Chalfant had found that Jackson failed to submit other information in the case and refused to delay the trial so Jackson's attorney could remedy the situation or continue negotiating a settlement. Ayscough & Marar isn't the only law firm who has chased after Jackson for unpaid bills. According to E! Online, the firm Wachtel & Massey quit a New York breach of contract case when Jackson stopped paying the bills, although Jackson claims he fired them. A 31-year-old illegal immigrant from Mexico with three prior deportations, Hernandez quietly followed the agent and promptly was detained on suspicion of illegal re-entry after deportation, said Gregory Palmore, an Immigration and Customs Enforcement spokesman in Houston. The case would be unremarkable, except for the setting. The fact that Hernandez was detained in church has sparked controversy locally. Hernandez was arrested Oct. 26, pleaded guilty to the re-entry charge this month and is scheduled for sentencing in April. He remains in federal detention in Conroe. Hernandez’s attorney, Rick Soliz, said he plans to file a complaint against the ICE agent in connection with the arrest. “I wonder what the agent was thinking, if he was thinking at all,” Soliz said. “How do you decide to do that in the middle of a religious service?” ICE has demonstrated a long-standing reluctance to detain suspected illegal immigrants at churches and schools. The agency waited more than a year before arresting Elvira Arellano, an illegal immigrant from Mexico who publicly took sanctuary in a West Chicago church to avoid being deported and separated from her U.S.-born son. She was picked up after she left the church and traveled to Los Angeles in 2007 to launch a national campaign for immigration reform. Palmore confirmed that Hernandez was arrested at the church in October, calling it an “unusual circumstance.” But he defended the agent’s actions as fulfilling his “sworn duty to enforce the nation’s laws.” He said the agency has guidelines related to arrests “in sensitive community locations.” Palmore said those guidelines are internal and cannot be made public, but they allow agents to make arrests at churches in specific circumstances. I recieved a letter just the other day from the Superior ciurt of California, county of los angeles that was extremely hard to understand. this letter was half a paragraph long. Good morning everyone, I received a citation exactly 23 days ago. On the lasuperiorcourt.org website, there's a disclaimer that some citations may take up to 21 days to show up before one is able to process them. Now, I've received 2 other traffic citations in the past, and they've both appeared on the site the next day, if not within hours of receiving them. If it looks like it's not in the system, should I be concerned at all? Could it have been lost/ destroyed? Can I use this as an excuse if this comes back to bite me in the butt in the future?
