Open Question: Why am I responsible for a photo enforcement ticket if they cannot prove that I was the one that was driving?

I received a photo enforcement ticket for going 11 mph over the speed limit (40 m.p.h.) on an interstate in Washington D.C. (1). Why in the world in the speed limit on the interstate 40 m.p.h.? (2). What is the rationale for issuing a ticket to the registered owner of a car, rather than the actual person driving? How do they know that someone (say, a valet at a restaurant I was eating at) didn’t take my car for a spin, unbeknownst to me? (3). Are cops required to be college educated? They sure don’t seem to be? [comment unrelated to photo enforcement ticket] (4). Haven’t some states ruled that photo enforcement unconstitutional? (5). Doesn’t it seem like an abuse that, during February 2010, D.C. issued more photo enforcement tickets (the combined fines totaling upwards of $390,000,000) than there are residents of D.C., Maryland, and Virginia combined? (6). Why is justice out of reach of ordinary citizens? We like to talk the big talk about “justice” and “freedom” and “responsibility”…we pay our taxes to dress our police officers up in their cute, spiffy little uniforms and buy them cars with flashy lights on top…we follow, unquestioningly, whatever the black-robed supreme court justices tell us, but when it comes down to fighting a traffic ticket…you have to have hundreds of dollars to hire attorneys…who, in turn, has spent hundreds of thousands of dollars, and years of their lives, studying the law. Isn’t justice is out of reach? Aren’t police officers just hired thugs who parade behind the empty symbolism of badge and the cold metal of a gun? P.S. It does not matter if I was actually speeding or not...my guilt it under scrutiny, but rather the efficiency and justness of photo enforcement ticketing more

Resolved Question: What constitutes an "Emergency Lane Change" and is it legal in Maryland?

I was on a two lane highway and the vehicle in front of me broke down and began to slow down VERY quickly, it was in an intersection and I was afraid that the breaking down vehicle was going to trap me in the intersection. I turned on my turn signal, checked for traffic behind me, (there was none) and quickly accelerated around the disabled vehicle, then signaled to get back into my original lane. Was this legal? If not, what would the proper procedure have been? more

In the latest of several lawsuits filed by illegal immigrants against U.S. law enforcement agencies, a Mexican woman claims that an Arizona sheriff’s department mistreated her during a workplace raid that led to the arrest of dozens of undocumented workers. For three years Celia Alvarez used a fake identity to work at a Phoenix landscaping company that was raided last fall by the Maricopa County Sheriff’s Department. Alvarez, who has four U.S.-born anchor babies, was among the 60 illegal immigrants arrested in the operation. In a federal complaint she accuses Maricopa Sheriff’s deputies of negligence and mistreatment for arresting and interrogating her. Alvarez also claims that deputies violently struck her and denied her medical care for several weeks during her two-month detention. She is seeking damages for illegal search and seizure as well as assault. The arrest also traumatized her children, Alvarez says, especially her youngest because he was still breastfeeding at the time and his mother was not available to properly nourish him. She asserts that the incident has marked her for a lifetime and hurt her kids, who as U.S.-born citizens collect public assistance. The struggling, unemployed illegal immigrant with four young children assures she’s not interested in the money she “could get out of this,” but rather in denouncing the “abuse, cruelty and inhumanity” of how she was treated by the local sheriff, which she worries will “go after more people.” This seems to be part of a growing trend among illegal immigrants and their advocate pro bono attorneys to sue law enforcement officials for doing their job and local governments for enforcing their measures. In the last few months alone legal action has been taken against an Ohio sheriff deputy who helped deport a Mexican with false identification cards, a Maryland officer who arrested an illegal Salvadoran woman and federal agents who apprehended a group of illegal aliens in a Connecticut immigration raid. A few weeks ago a group of undocumented day laborers sued a southern California city (Costa Mesa) for banning them from seeking work on public streets. The lawsuit actually stems from the arrest by local police of a dozen illegal alien day laborers who violated the city’s anti-solicitation ordinance. Voting Question: Letter to Judge on traffic ticket?

I recently got a parking ticket and my vehicle got towed. I went to court and the judge did reduce my fine but since the verdict was guilty i would not be able to get a refund of the towing fee which is a really big amount and in these time that money could be put to better use. I'd like to know if it is worth writing a letter to the judge explaining the situation in more detail and requesting for some assistance. Do judges even acknowledge such practices. I know i am guilty and dont argue that. But a not-guilty verdict will definitely help. I am in the state of Maryland if that helps. more

Resolved Question: motorcycle or car?? which should i try to get?

im a sophomore in high school right now, im 15 and im about 5'6 in height -it is relevent i was wondering about buying a motorcycle or just driving the suv we have, we have a 2002 izuzu trooper and a 2008 saab 97x aero, but im not getting near that for like 6 years. i am very much into cars and bikes. since i could talk i was able to name all the cars on the street, and from time to time ill try to identify the cars i see on the highway ( oncoming traffic so its a speed challenge) i usually get all them right. Anyways i thought that it would be fun to get a motorcycle whenever the law permitted i think its 18 for maryland. im also a big biking fan i learned to bike when i was 4 ( 2 wheels) i bike around very fast ( top speed ever would be 30mph) and have come close to being hit a few times ( about 7-8 times) from stupid cars ( jk i love them) i have what you could call a dangerous attraction to speed. i can drive fine its just that i need to work on braking smoothness ( i dont slam on the brakes though) . if i were to settle for the car then i would just be as is and drive the SUV, or the bike. for the bike i would have to work a couple of summers and star saving up money. my parents are afraid for me because of the risk involved in biking, my uncle has had a few bikes. they are trying to keep me away i guess. if i got he bike id prob start with a 500cc or 250cc. but i was also thinking that i should save up for a nice car one im out of college. im only considering a bike because of its size, and power-to-weight ratio, which always beat car. if u read this whole thing thanks, so what do u think i should do, 1- get a bike 2-stay with that isuzu trooper till after college more

I responded to a craigslist add to buy an xbox for 200 dollars. this person orgional said he was comign to my house to sell it to me, but it turned into meeting halfway, to me going from va to md to meet him. in total i spent from 2-7 going where he told me to. i basically waited in part of maryland he told me to as he made a billion excuses for why hes running late.(drive was 30 mins so its not like i spent much of this time driving to md) my favorite excuse was he took his mom to ER. he also claimed traffic was an issue(i was there and there was no traffic wahtsoever in middle of the day) he eventually told me to meet him at a wendy's on rockville pike where i waited for over an hour. (i spent previous wait time in a random parking lot in city he told me to go to. he told me id get the adress when i was in city. and he kept promising to give me phone number. i gave him both my nubmer and address several times. he never called. so as i was waiting at wendys he kept saying how he wanted to meet outside and blah blah. so eventaully after waiting for hours and realizing this guy is playing with me i start searching whitepages for the last name carey (his email address had carey in it) i find his mom and she says he will be back around 8 from night classes!!! so on my way home i get a call from him verbally assaulting me calling me a stalker for looking up his phone number(i never said anything to his mom except if kevin was there) and he claims he sold it to a friend at around 2 (meaning he was toying with me the WHOLE TIME!!!!) so then i call his momw hen i get home and she said he never even had an xbox and that he is a pathological liar. I wasted sooooo much gas driving around and got caught in so much traffic because of him in all this went from 2-8:30 but 2-7 is when i was in md waiting. can i make a case from this? more

Resolved Question: Saw child in dangerous living conditions, what do i do?

I work for a satellite company and today while installing in a home a few towns over from my own in maryland, I saw 4 children living a home that was NOT fit for children. There was black mold all over the kitchen, trash EVERYWHERE, car batteries near the sink on the kitchen table, roaches everywhere, mold smell, and to make it better 5 gallons of kerosene in the living room with 3 kerosene heaters in the house with a STRONG smell of gas and the fumes where not ventilated at all. I generally do not get involved in other peoples business or what i see at work (its almost a weekly thing to go into a home and see obvious drug trafficking and other illegal activities). What can i do? I want to remain anonymous but i want someone to take these children out of there current living courters, it is NOT a place where a child needs to live. more

I received my first traffic ticket today in Maryland. The violation was 21-201 a - Failure to Obey Traffic Device. I turned down a side street and made a U-Turn so that I could go back in the other direction. Me and everyone else who made the U-Turn were pulled over shortly thereafter. The officer told me that there was a sign stating that U-Turns were not allowed. Me and hundreds of others make the U-Turn everyday and have never seen the sign. I went and looked and the sign is so close to the turn that you will not recognize it if you are making the right onto that street. I don't care about the fine. It's the points that I don't want. It is a fairly new law that states if any emergency vehicle is on the side of the road, if you are able, you are to move into the far lane. The cost of the ticket was $754, with 3 points on your license and a mandatory court appearance. I have got two traffic tickets/two traffic convictions. on a proviional license in the state of maryland if you get two traffic convictions it's an automatic 30 day suspension. i work at a car dealership and if I lose my license I will lose my job. I live in maryland, in october I was convicted of neglegent drivng for something that took place in march. in the month of october i got a speeding ticket in va doing 89/65 reduced to 79/65. I had to pay 400.00 and complete improvement class. my question is, do both of those count as convictions and if so does that mean my maryland license will automatically get suspended for 30 days becuase it says on the website two convictions=30 day license suspension. reason im asking is i just started work as a car salesmen today in a job where you cannot have a suspended license or you get fired. i come home from work and there is a notice in the mial my license is being suspended for 30 days and i have no idea why. more

Resolved Question: Different laws for bikers with disabilities?

I have low vision. It's low enough that I can't drive because I can't see traffic lights and signs. But I can ride a bike. I live in a part of Maryland with no public transportation and my only methods of getting around are biking or walking. I know the laws say that a bike isn't supposed to be ridden on the sidewalk and that you have to ride it in the street, but I thought I heard once that it is ok to ride on the sidewalk if it is unsafe for you to ride in the street. Does anyone know whether the biking laws are different for the disabled?I also really don't need unhelpful comments about how I should not be riding a bike. You can't see what I can see so don't presume. I can see where I'm going fine. more

Again, this is purely hypothetical. Let's say one lives in a state such as say Maryland, that does not issue CCW permits under almost any any circumstances. As an otherwise completely law abiding citizen in every other respect, one decides that the need to protect oneself and his family outweighs the State's mandate that concealed carry is a no-no. Logic would dictate that if that person has never run a fowl of the law in the past, and does not find himself in situations or places where he could get into trouble by the police in the first place; then, there would almost never be time when the police, the state, or any other citizen would even know that the said law abiding citizen is opting to protect himself and his family in spite of the law. What are your thoughts on this attitude as a law enforcement officer? If, for some reason, maybe at a traffic stop or some other such thing, you came across this guy and found him to be otherwise completely clean, except that he was CCW-ing, what would you do? Let me start off by saying that I reside in Maryland. On Oct. 21st I went to Newport News, VA to visit a friend. While I was at a complete stop (waiting to make a left turn) I was hit from behind. Once the traffic was clear, I went into the parking lot and the other driver followed. She apologized and said she did not see me because she was on the cell phone. She told me that she would pay for all damages done to my car. (she was driving her sister's car) She said that she had just taken money from her 401K and would rather just pay for it out of her pocket. (said she didn't want to bother her sister's insurance). She gave me all her information including her work phone number, cell number, vehicle ID number and her sister's driver's license number. I told her I would get some estimates and give her a call. I called her several days later and told her that I had gotten two estimates and they both were about the same. $1060 and $1050. She said she would give me 500.00 one week and 500.00 the next. Well, wouldn't you know it, her cell phone is not able to receive phone calls. Now, I want to know where do I file the small claims case? Newport News or Maryland. I am not going to use my insurance because my deductible is 1,00.00. So it makes no sense to use it. Please advise. more

Hi! We are about to relocate to the area and have been looking at homes online. We are interested in one home that is located near National Harbor in Maryland, I, however, will be working at Fort Belvoir (southern part). What is the commute like? Map Quest says it's a 20 minute drive taking 1 to Fairfax County Parkway but I don't think that takes traffic into account. I looked into the metro but the site tells me I would have a 2 hour commute each way! So what if I were to drive instead? Is traffic heavier going one way vs. another at rush hour? (Howard County, Maryland) I was in a hurry to get home late at night and at a four way traffic light stop which was green at the time. As I approached it turned red and I sped up and took the right on the red turn without yielding and at the other end of the light was a cop and he pulled me over for not making a full stop at a red light. And by the way this is my first violation and I am still on my provisionals. I was told to contest it and plead guilty with explanation in court so I could just pay the ticket and get no points. What explanation, or suggestions do people have about how to handle this or else I will have to carry the provisionals for another 18 months and possibly pay for a driving course. Thank you. more

Three Hispanics believed to be here illegally face charges of bribing a Gaston County driver license examiner with $300 to get a driver’s license, according to arrest warrants and affidavits. DMV inspectors arrested Claudia Morales Rodriguez, 29, and Alfredo Lopez Hernandez, 29, both of Gastonia, and Juan Alberto Goddy Vasquez, 37, of Kings Mountain on charges of attempting to bribe a state driver license examiner to obtain a driver’s license. All three are believed to be in the country illegally, according to the DMV. They were placed in Gaston County Jail under $10,000 bonds Monday. Their release remains on hold by Immigration and Customs Enforcement pending a review of their immigration status, according to Gaston County Sheriff's Office. The arrests stem from an investigation of a document lab that had equipment and materials to manufacture counterfeit resident alien cards, Social Security cards, birth certificates and driver licenses from six states, according to a release from the Department of Motor Vehicles. DMV inspectors arrested Mario Ziranda, 35, and Elvis Sanchez, 28, at their residence at 272 Roberson Lane, Forest City. They face charges of common law forgery, manufacturing North Carolina driver licenses, felony trafficking of identification documents, possession and delivery of cocaine and misuse of vital records. Searching the Forest City residence revealed ledgers showing hundreds of fake document sales weekly, according to the release. Driver licenses from California, Florida, Tennessee, Texas, Ohio and North Carolina were found at the location, along with Social Security cards and a Maryland birth certificate. Investigators also seized $8,000 in cash and 15 grams of cocaine. Sanchez has no legal United States documentation, according to the release. Both are being held on $75,000 secured bond in Rutherford County Jail. DMV spokeswoman Marge Howell said she didn’t know how the three suspects in Gaston County were connected to the Rutherford County suspects, but all were part of the same investigation. “We have had a lot of these things happen, pop up all over the state,” Howell said. The License and Theft Bureau performs more than 3,600 fraud investigations annually, Howell said. “A lot of them are fraudulent document cases,” Howell said. License and theft inspectors from Gaston, Burke, Lincoln, Catawba and Cleveland counties conducted the investigations and made the arrests, according to the release. Law enforcement officials from the Gastonia Police Department, Forest City Police Department and the Rutherford County Sheriff’s Office assisted with the arrests. Gastonia Police Sgt. Jimmy West said none of the trio arrested in Gaston County spoke English. One had been here 15 years, another had been here for nine years and the third had been here for six years, he said. “We’ve always had issues with fake driver’s licenses, fake ID cards,” West said. This isn’t the first investigation like this in the county and it won’t be the last, West said. MARYLAND STATE CONFERENCE OF NAACP BRANCHES v. MARYLAND STATE POLICE 1. The Maryland State Conference of the NAACP has brought charges against the Maryland State Police stating that they violated the plantiffs' Fourth and Fourteenth amendment rights during a traffic stop. 2. This case is being heard in the District Court of Maryland, as the charges are being brought against a State Agency. 3. The Plaintiffs were driving with the flow of traffic along I-95 in Maryland when a State Police Officer began to follow them. The Officer then stopped the plaintiffs several miles later. Upon approach of the vehicle, the officer made verbal acknowledgement of the plaintiffs' races, and harrassed them, calling them "Jamaicans" and stated that there had been problems with people of that race in the area, even though the plaintiffs were not Jamaican. The officer then proceeded to, without probable cause, remove the plaintiffs from the vehicle and search the vehicle thoroughly without consent. The initial reason for the traffic stop is stated by the Officer to have been "speeding." 4. The question is whether or not the 4th and 14th amendment rights of the Plaintiffs had been violated. If, in fact, the events happened as the Plaintiffs suggest, their 4th amendment rights would have been violated when the officer removed the Plaintiffs from the vehicle and thoroughly searched it, and their 14th amendment rights would have been violated when the officers did not provide them with due process in regards to the extensive search of the vehicle. 5. The two sides of the case are the State and the Plaintiffs, the NAACP members. The State contends that: the incident in question did not take place. The accused Officer states that the Plaintiffs were never removed from their vehicle and never searched. The Plaintiffs contend that: they were unlawfully and unconstitutionally racially profiled against in this stop and were, in fact, searched and constitutionally violated. 6. The Court finds that the conduct by the arresting Officer towards the Plaintiffs was a violation of the Plaintiffs constitutional rights to unreasonable search and seizure. more

Back in early 2008 I was pull over and my tags were taken and I received tickets for driving with suspended registration due to MVA not having record of my Insurance. I was able to resolve the situation and get my insurance information to the MVA and I got my tags back. Apparently, the tickets were still there and becuase they werent paid my driver's license was suspended. I got pull over over the weekend and they took my driver's license and gave me two tickets for driving with a suspended license and got a citation to court... all of this because of something that was wrong in the first place with the MVA.
