Open Question: Texas inspection scam on my old truck?
I have a 1980 Chevrolet C-10 with a 350sb. The intake does have an EGR valve. The carburetor has an after market air filter. Nothing fancy or race type, just a round housing with a paper filter in it. The truck easily passes tailpipe emissions thanks to the miracle of ethanol. The problem I have is, I took it to get it state inspected. The guy told me I'd have to get new wiper blades. I did need them so I was like ok then and bought some from him. He installed the wiper blades and said I will need new tires soon that mine barely made it. Ok, fair enough. All lights worked, horn worked, then he popped the hood and sighed. Said I would need the original air filter housing that came on the truck. My truck runs smoother and cleaner exhaust with the new one. I don't have the old one so what do I have to do? He offered to sell me one he happened to have "laying around" with a new heat riser tube. Except my manifolds don't have the place to put a heat riser... Is this really necessary to pass or is this guy just trying to rip me off?I believe I found my answer in the inspection guidelines from the DPS. My vehicle originally came equipped with thermostatic air cleaner. However, like I said my emissions testing comes with better results with the after market filter and housing installed. I passed with it the previous time so I just sold the old one off because it was just taking up room.OH! and the premise behind the Thermostatic Air Cleaner is that the heat from the exhaust is pulled through the carb, thus reducing choke time on engine warm up. I have read that a few judges in Texas and Tennessee will do this - for instance, forcing a shoplifter to carry a sign outside the store they stole from that says, "I stole from this store." I want to know which states (and if possible, which specific cities/judges) actually do this. FYI, I am not looking to go gawk at these people. It is precisely the opposite. I think this punishment is a human rights violation and I would like to get involved in preventing it. That regardless of my our your political affiliation" Dem/Lib, Repub/Con " that we together are still the minority in America regardless of our opinions, well at least we have one because we took the two seconds to learn a few things about our government. Ever looked at the voting results per State, even here in Texas out of the millions that live here its usually only about 1/10th of my States population that actually votes like so many other States which is even sadder than most questions that the majority of people ask on this site, and that's saying a lot. I worked for a Bailbonds company at 18 then got licensed to work for a Private Investigations agency... However at 19 a committed fraud an act that will forever regret.. Immediately my P.I license got suspended until the outcome of the case. I was tried and convicted in two counties with a total of three felonies. I was placed on deferred adjudicated probation. However I had started working for another P.I company in Louisiana After several months I was hospitalized involuntary for attempted suicide there.. The probation officer asked the judge to issue a warrant for leaving the county/state.. Court records show the warrant was issued in Nov, 2009. I now live in California and recently had my fingerprints live scanned at a police station for a job, and came back clear.. I'm considering moving to WA, and start a new career... This has almost ruined my husband!?
I know this might be lengthy, but I feel it is important that all details are known for anyone to completely understand. My husband, our 4 children, and I have resided in Eastern Texas for the past 11 years of our marriage. My husband had retained employment for several years at a very successful car dealership until the decline of the economy. Suddenly, it became clear that in order for our family to survive, we would have to relocate to a bigger city. We choose Austin and my husband applied for several jobs. One company, in particular, was constantly brought up during this process-Colburn (I am unsure of the spelling.) Colburn provides a full criminal background check via a phone interview with the potential employee and computer records for many HR departments/business organizations that utilize their services during the hiring process. Suddenly, job opportunities that my husband was way over-qualified for were not possible and we didn’t understand why. Here are some important facts: My husband’s younger years were littered with a few run-ins with the law, but nothing but misdemeanors. The first incident occurred when my husband and his college roommate threw a party at their townhome. After the party became a bit rowdy, the police were notified and found that one individual at the party was aged 18 and drunk. My husband was 21 at the time and was naturally found liable, which resulted in a year of probation. My husband and his high school sweetheart both attended the same state university. Unfortunately, his girlfriend at the time was dying of cystic fibrosis. Her parents were begging her to quit the cheerleading squad and college and come home for the betterment of her health immediately. After this unsuccessful attempt, the asked my now husband to talk to her himself. He took his roommate’s car (his roommate kept a gun for protection in this vehicle) to confront his dying girlfriend in the university parking lot. The conversation became very heated and the two began yelling at one another. Unfortunately, a large portion of the college football team heard them and came to what they believed was the aid to one of their cheerleaders. The football team began to rush and hit him and my husband’s reflex action was to grab the gun from under the front seat of the car to scare them away. He never fired the gun, nor did he hit anyone with the gun. This tactic worked and the football team scattered away and then called the police. My husband was charged with a misdemeanor due to this incident, even though he was trying to defend himself from several large men that where attempting to pound him. The fact that he was still on probation did not help matters. What is important is that it was a misdemeanor-period. It wasn’t even considered assault of any kind. At first, the police were going to charge him with assault until they realized they had made a huge mistake. This new misdemeanor meant he had violated probation, which resulted in a year-long county jail sentence-County jail, not prison. Now back to present day, my husband tried unsuccessfully for almost a year to find employment in Austin and Dallas to no avail. With every new potential career opportunity, we were hopeful, that is until after he completed his background check and would received a swift “no.” We couldn’t figure it out. Finally, my husband’s old boss called him to offer him a job closer to our hometown. Even though my husband had known this man several years, he had to go through the same process each new employee goes through-which is completely understandable. Among this process was another over-the-phone interview with Colburn. When his old boss received the report, he was stunned to find that this report stated my husband had spent a year in PRISON! The report gave a detailed account of what happened, but left out the misdemeanor part and instead of reporting that he spent a year in county, they reported that he was in prison. His boss explained to my husband that had he not known and worked with him previous, this would have prevented him from getting the job. It is completely clear to us now why my husband was turned down so many times for jobs that he was more than qualified for, but now what? I have no idea where to start to rectify this issue. My husband is very near to completion of his bachelor’s degree in business, but what good will his degree be with this type of false information coming up on a background check? Does anyone have any suggestions on where we go from here? He has worked too hard to have this happen. How does one go about changing a major error like this and who would be responsible in giving this background check company and any others this incorrect information? Any suggestions are greatly appreciated, and again sorry this is so lengthy. Thanks!in response to the first individual that answered, county jail is not a state prision. He was never in a state prision. It was not a felony charge. It was due to probation violation.The report does not state that it was a misdemeanor, but because he violated his probation, he was given year in county jail. I say that if an employer sees an incident with a gun involved with no specific charge and prison-not county jail, they are going to think the worst. My problem is how to we change it to report it was in fact a misdemeanor and that he was in county jail-not prison. Again, the only reason he was sentenced a year in county jail was bc he was on probation.My husband was told when this incident had occured that if he had not been on previously put on probation due to a minor drinking at his college party, he would have not recieved anything, but a slap on a wrist. The football players that assaulted him got nothing. He was just a short 140 pound guy with no way to defend himself against 200 + pound guys. Before I moved to US, I lived in an Asian country. There, I had a severe competition with my cousin even though he was older than me. We both wanted to excel more than each other. However, I moved to US in 4th grade, while he stayed back home. But now, I found out that he is currently attending University of Texas Austin, which I believe is a top university. I really want to go to a college that is better than U of T A, so this year, as a junior, I am taking AP Chemistry, AP Biology, AP language and Composition, Honors PreCalculus, Organic Chemistry, Physiology, and two study halls. After my junior year is over, I will also take my SAT in June and SAT Math 2C, SAT Chemistry, and SAT biology in following months, during and before my senior year--yet in time for college admissions. I am hoping to attain a very high GPA, because I am completely devoted to my studies. Also, I am hoping to get 700+ score on all of my SATs. Furthermore, I am also researching and developing a case study on physicians--too complicated to explain here--I am also going to volunteer at Ohio State University's medical department, and I am going to shadow my Mother at her job--Oncology. Moreover, I also worked for two months during my freshman year at a MAC's convenient store in Canada, and I won the best student award in Physical science. I can speak three languages--English, Hindi, and Urdu; and I can read but not comprehend Arabic. And I have some competency with Spanish. So, please tell me if I was to achieve my set goals this year, will I have a chance at an Ivy league, or any university that is better than University of Texas Austin? I would like to hear from some police officers on this one please! But also from citizens who have been abused. Police in cities like NYC, LA, Chicago, Berlin, Singapore, Mexico City, and in most red neck Texas towns, walk around like they have a chip on their shoulders challenging someone to knock it off. If you make eye contact with them they try to stare you down, and if you smile at them they don't smile back. If you try to talk to them they become immediately suspicious, and can quickly become aggressive, belligerent and abusive. They have been known to use foul language with very little provocation and to taser people will little or no warning. On the other hand police that I have encountered in cities like London, Manila, Austin, Dallas, Ft. Worth, Albuquerque and Miami seem to have a tolerant live and let live attitude. They are calm and courteous and their speech invites cooperation rather than arousing alarm and panic as the aggressive speech of some police in LA, NYC, and Chicago. Why do police become this way? Normal people aren't this way. Is it the type of people that are attracted to this kind of work? Is it the culture that they learn from other police officers? Is it the local culture that they are part of? Is it their training? Why, why, why? What can we do to have police officers that are courteous, respectful, professional, and will guard our dignity? Do we need better screening? Better pay to attract better people? Better examples? Better training? Special review boards? Better ways to monitor police rudeness? Special play by play video peer review of citizen police contacts? What can get us the kind of police that we can always be proud of? Can someone also address this: I am concerned too about the way police treat you in these circumstances. 1) Like at first at a traffic stop they come up to you and ask nicely for your papers. If you don't cooperate right away they start ordering you around like you are a dog or a disobedient child, Then they quickly escalate to the point where they are dragging you out of the car or breaking your window if you don't roll it down. Its obvious that at first they didn't mean to be courteous but were just using it as a ploy. 2) Also when they ask you for identification even when you are just walking on the street minding your own business and there is no apparent crime that you are aware of, you ask them why and they won't answer, they just keep asking your for your ID, then when you don't show them they arrest you for not having an ID, even though they can not ask for identification for a person walking in public unless there is a crime apparent. 3) Or they arrest you for disorderly conduct even though all you are doing is standing still and just talking politely to them. Disorderly conduct has definitions which involve "...being in a drunken state or other behavior sufficient enough to arouse alarm in a reasonable person." 4) Other things too like traffic cops who drive too slow on the freeway and when you swerve to try and avoid them they pull you over for not turning on your lane change signal. (This really happened to me once and it was so obviously a setup, the cop wouldn't even come up to the window he just told me to get out of the car from back by the back wheel well. Then he asked for my license and I had to open the trunk to get it out of my brief case - he almost had an orgasm when I opened the trunk so you know that's what he wanted all along - my license was expired but he didn't even notice just gave it back to me). Isn't using these kind of tactics of creating a breach of law, even though quite minor, as a means of invading a persons car or home illegal? Aren't these all just power trips that police are trained to employ when they don't get their way? Couldn't they be trained to be calm, inviting of cooperation, and communicative about what they need and why they need it. Why do they have to be so manipulative? I notice also that when I wear a suit and drive my Crown Vic with Marine Corps sticker and Scale of Justice rear window decal that I get a lot more deference from police officers. Why is that? I am a female, and 18 years old. I'm in college, but have most of my credits out of the way. I am currently engaged to my boyfriend, who has a son that just turned two. While we do plan on getting married, we would like for me to adopt him as my son! I was wondering if in the state of Texas, if you can do that at 18? I do know that there is not a marriage requirement in Texas. The mother of our baby has had nothing to do with him all his life, and signed off on her parental rights when he was two months old. Anyway...) It is my understanding that child support laws are not standard, and each state and individual county can do whatever they want. Am I right? According to the State of California, each county works things differently, and there is no higher department to make complaints to if you feel your county is being unfair. Here's the deal: I live in this dreadful area known as Solano County, California (Fairfield/ Vallejo/ Vacaville area), and I am a single mother of a 3 year old toddler who has been receiving child support from a deadbeat father who resides in another state (he moved to Texas). My daughter is not of school age yet, so that means that it COSTS to put her in daycare or preschool if I was even lucky enough to find a decent enough paying job in this tough economy. Unfortunately, since the deadbeat (who doesn't want to see our daughter) keeps quitting and taking temporary jobs, I don't always receive medical benefits for the child. I had a job that I lost and am looking for work as well (but, other than the fact that I do get Medi-cal, I am not on welfare since I have managed to live off of savings.). I am actively seeking employment. Unlike me (I lost my job), I do know that the deadbeat father has quit one of his jobs and has taken lower paying jobs since then. I also know that most counties and states (including Monterey County) are not in favor of deadbeats who deliberately quit their job and take a lower paying job at any point to get child support lowered. Unfortunately, 8 months ago, Solano County allowed the deadbeat father (who was residing in Texas) to get away with taking the lower paying job and granted him his request to get child support lowered. The only way I might have had a chance to fight this is to take the matter to the court. I didn't want to go through that humiliating experience, so I decided to agree on the lower stipulated amount. Currently, the deadbeat isn't working at all. I did notice that he has a resume online that indicates he's looking for work (in other words, he is not disabled or anything like that, and his last job was temporary). Solano County child support does not welcome my calls to ask any questions regarding this matter. They have sent me a letter saying that he is being granted another modification request because he is not working. This makes me wonder if this county will allow him to not pay child support at all??? Again, most counties, and states, especially the state of Texas, have no tolerance for a deadbeat who doesn't want to pay nor see his child. If I didn't need the Medi-cal insurance, then I might be able to move my case to another county (or even Texas might have a say in this matter). But unfortunately, because I need the Medi-cal for the child, Solano County gets to do whatever they want (that's the perception I get from the State of California, anyway). My question here is....why the heck does my county differ from so many other counties and states out there? It seems to me that they are on the deadbeat father's side and they don't look out for the needs of the child. I'm also wondering.. (if anyone is familiar with Solano County, that is), what are the odds that the Superior Court in Solano County will be able to see through this deadbeat and not allow him so many modifications? Again, if it were up to the State of Texas, in no way would they allow this.....By the way, in case anyone feels that the system is standard in the State of California, it is not, believe me. Here is the story, I just finished moving from florida to texas and my truck died, i sold it to a guy on craigslist for next to nothing and cancelled my insurance... Oh and that would be just the start, each congressional delegation would fight for sub-offices & more employees to add more cronies on the payroll. Then comes an issue of state rights and how the Federal Gov. can come in and abolish state commissions. Do any of you think CA, NV, NY or TX would tolerate that? 2. the professional sports league set up: A. Who will be in charge of this "commission"? How in the world will they fund this huge organization? It's easy to say increase fees, but that also means more fights outside the country (& decreased revenues) because of it. B. I don't mean specific majors such as biology or something. I need to know what specific classes I would need to take in an undergraduate program in order to qualify for vet school. If you have a complete list of every single major accepted, that would be fantastic as well. :) Basically, I'm trying to figure out different paths that I could take to get in to vet school while still having a wide spectrum of options in undergraduate. I want to go to a college/university that offers something aviation related(esp. commercial aviation) and also offers any set of classes or a major that Texas A&M (or even Auburn, Cornell, or Colorado State) might accept. Sorry that this is such a long question! I just want to try and go to school with someone who wants to be a pilot while I want to be a vet.
