State Of Texas Questions asked

Open Question: Is this paragraph plagiarized?

here is the original... http://www.landmarkcases.org/roe/background3.html and is this a paraphrase of that?? I'm not very good at paraphrasing but I tried very hard! If you have part that could be fixed in any way please say!! sorry its kinda long but any help is appreciated! In the early twentieth century, most states had firm laws against abortions, outlawing it unless the life of the mother was in danger. Some women went to the extreme of having back alley abortions, in unsanitary conditions that were extremely dangerous. Some states eased their abortion laws when there was public pressure from the sexual revolution in the twentieth century, which made it easy for women to find a doctor that was willing to perform an abortion. The concept of equality was raised when poor women could not afford to travel to receive an abortionIn the constitution, there is no guaranteed right to privacy, which was a main dispute in the Roe v. Wade case. The Supreme Court associated privacy to location, mainly on a persons home, because it is personal property. Later on, the Court’s changed their position on privacy, connecting it to a person, not a location. In the Griswold v. Connecticut case, Connecticut outlawing birth control was ruled unconstitutional because of invasion of the privacy of married couples to make decision about their family. Despite the fact birth control access was extended to married couples seven years later, it was still expensive and not everyone could afford it. People argued that protecting privacy, although not in the constitution, is based on the Due Process Clause of the 14th amendment. Jane Roe, an unmarried and pregnant woman living in Texas in 1970, wanted to have an abortion but could not because of the Texas law saying you cannot have an abortion unless for medical reasons. Roe filed a lawsuit against Wade, the attorney of Dallas County, Texas, to challenge the outlawing of abortion. Roe argued that outlawing abortion violated the 14th amendment rights, providing equal protection of laws and guarantees personal liberty, and a woman’s right to privacy. The state argued that “the right to life of the unborn child is superior to the right to privacy of a mother” and that in previous cases the Court’s protection of individual rights or marital privacy, that right was not absolute. A federal district court ruled the Texas abortion law unconstitutional, and the case was then appealed to the U.S Supreme Court. The Supreme Court ruled 7 to 2 in favor of Roe. Thank you soooo much!!! more

Open Question: What can grandparents do when their grandchild is put up for adoption without being informed.?

Our son and daughter in-law that live in Idaho put their baby up for adoption without informing any family members. His dad and I live in Texas so we do not see them or talk to them very often. The day after the baby was born, they informed us that the baby (which is a girl) was put up for adoption. Had they let us know that they where not in any financial state to take care of this child then we would and still would raise this child. This young couple already has two other children ages 2 1/2 and 16 months. They are have marital problems also. But we are outraged that we where not informed of this adoption and given a chance to raise this child. Does any one have any suggestion for us. We cannt get our son to talk to us about it. The baby was born February 15, 2010 so we still have some time. Please help!!! more

Open Question: What are the newest (youngest) Universities in the state of Texas?

Open Question: I live in northern VA and I'm so done with it. Where should I go, please give ideas based on criteria below.?

I will pick best answer based on a tally of points. You can find what I award points for as you read. Preferably out west. *5 points for this* I like SUN *10 points*, warm weather *5 points* also but can deal with cold as long as its sunny. LOTS AND LOTS of OUTDOOR activites. Nature, organic farming (10 points for being an organic-minded city/town), fishing (5 points for great fishing), rivers, lakes (5 points for rivers or lakes within 20 miles). Within 4-6 hours drive of a beach is a plus(5 points). I'm unconcerned with job/salaries because of the nature of my work. What I do look for is low crime/drugs *20 points*, good schools *10 points* (I have 2 young kids). The states I like are California, Oregon, Colorado, Texas, Arizona, and New Mexico in that order (5 points for suggestions made in those states). Would consider Montana/Wyoming but I don't know much about them and they are kind of out of the way. If there's any great places out east or central feel free to throw those in. I like fairly rural within 100 miles of a larger city. If there are any colleges with a good conservatory/music program that is a bonus *15 points!* Also every whole foods market or similar within 10 miles is 5 points. *5 points* for having a strong historical/archaeological aspect (ie:williamsburg, va) regardless of where you pick, even if its not out west and you didn't get too many points before I will award 25 points for the most unique appealing place that I wouldn't otherwise find out about. For example here in Virginia, Western Loudoun County has some beautiful small historic towns, with great vineyards, hiking areas, old town shopping, fine dining, and horse country aspects. If you can find something like that, additional *25 points*. more

Open Question: How do you enforce payment of a settlement when the party refuses to pay.?

Open Question: Is there a list of community college CEO contacts?

I work for a community college in southeast Texas and my boss is trying to compile a list of community college CEO contacts (Chancellors and/or President(s) if applicable) in the United States. The names and contact info (email and/or phone) for each college CEO are the most important at this time, but I also need to find (if possible) the time they came to office, the service area of the college, their annual budget, and their current budget. I have been currently going to each college website to attempt to find this information, but it is not always there and takes a very long time to search through one by one. The American Association of Community Colleges (AACC) looks like it might have the information I am looking for, but we cannot locate a current member at our institution in order to log in. The Texas Higher Education Coordinating Board (THECB) was pretty useful in terms of obtaining contacts for Texas, for which I have fortunately been able to retrieve names and emails,; however, the source still leaves me high and dry with no indication as to CEO background info for the time they came to office, service area, and budget information. Any advice would be appreciated. I know this is a lot of requested information for one question. I will be more than willing to post this question multiple times and choose the best answer multiple times for those who provide very useful information. Thanks more

Open Question: Do you consider this a legitimate criticism of the electoral college?

Small states are very much overrepresented. California only receives one electoral vote for every 668,303 citizens. Texas only receives one electoral vote for every 715,499 citizens. Wyoming, on the other hand, receives one electoral vote for every 177,556 citizens. Why or why not? Source: U.S. Bureau, Population Division.I understand why it was implemented. I just think its silly to for people to (still) say that the citizens of one state are all going to have the same interests. If that were the case, parties would be organized by geography, not ideology. more

Open Question: If Charter sues Wings in federal district court, is there subject matter jurisdiction? Please help me!?

Wings, Inc. is a Delaware corporation, maintaining its principal place of business in Washington. Wings is qualified to do business in every other state in the country. Charter, Inc. is an Oregon corporation, having its principal place of business in Texas and not qualified to do business in any other state. Charter has leased an airplane from Wings in California. Wings maintains a large facility in California for the sale and leasing of aircraft. California has a long-arm statue making the operator of aircraft in its airspace subject to service of process in California state courts. On take off from San Francisco, the airplane leased by Wings to Charter collides with the control tower, explodes and crashes. As a result, the plane is destroyed, $1,000,000.00 worth of Charter’s property is destroyed and Charter’s president is killed. Charter contends that Wings’ negligence in the manufacture and maintenance of the plane caused the accident. Wings contends that the negligence of Charter’s pilot (for which Charter is responsible) caused the accident. The proof of both Wings’ and Charter’s contentions will require the testimony of more than twenty employees of Wings, working in California and ten more individuals employed by the airport in San Francisco. (a) If Charter sues Wings in federal district court, is there subject matter jurisdiction? (b) Assuming there is subject matter jurisdiction in the federal district courts, from which district court or courts is Charter going to be able to serve Wings? (c) In which of the courts listed by you in response to question (b) will venue be proper? (d) If Wings sues Charter in federal district Court, is there subject matter jurisdiction? (e) Assuming there is subject matter jurisdiction for such an action, from which district court or courts will Wings be able to obtain personal jurisdiction over Charter? (f) In which, if any, of the districts listed by you in response to question (e), will venue be proper? (g) If Charter files an action against Wings in federal district court in Washington, and it is assumed the court has subject matter jurisdiction and personal jurisdiction over Wings and that venue is proper there, what procedural move is Wings likely to make? more

Open Question: Would Republican ideas really lower health care costs that much? By how much?

I hear them talking about opening up state lines and tort reforms... how much would that drop costs though? I've looked at tort reforms and while it seems to decrease doctor's costs, it doesn't seem that it's had a big impact on patient costs... in places like Texas and Mo... maybe 5 percent... but that's a year of increases as things stand now... so that buys us a year... and my state has several insurance companies, so we have competition... but it's still really expensive? is there one state with super cheap, but good, insurance that we could buy from if the lines were opened up? or are all of them about the same? it seems that these ideas could cut some costs, but I don't really see how they would solve any of the deep problems? not to mention the dramatic costs of medicaid and medicare... more

Open Question: Texas ticket question?

I was pulled over August 6, 2009 the officer ran my name, and said that my license was suspended. so he gave me a ticket for "suspended drivers licenses" Today I recieved letter from the state of Texas It stated that if i didn't pay for the ticket in full my license would be suspended as of MARCH 30, 2010 I called the judge a week after getting the ticket, and he said that it was not on file yet. So I called back the following week and he said that it still was not on file. I got a letter from my county that states they issued a warrant for this ticket. is there anyway that I can use the letter from the state of Texas to fight the ticket? since my license isn't even suspended until the end of the monththats the thing my license wont be suspended until MARCH 30,2010! I got a letter from DPS stating that IT IS NOT SUSPENDED!!!! And i dont have a failure to appear, here you CALL and schedule a time to see the judge, the ticket was never on file when i called, the judge said that it wasnt there so not to worry about it, tickets in texas are usually on file a few days after it was written, 3 weeks was sufficient time. more

Open Question: Help! Inability to stop procrastinating! :(?

Okay, recently I've started a new medicine for anxiety that really disrupts my ability to focus. Also, I've just relocated with my family from South Texas to Washington State-A big transition. I am a Freshman in high school, but all of my classes are either 9th grade Honors, or 10th grade honors. I've always had the problem of not being able to focus in class, yet I make REALLY good grades-I've maintained a solid 4.0 GPA since 6th grade! I'm a big over-achiever, and sometimes that causes my downfall. Also, I get really depressed...You know, when I recieve a bad grade in school. I just switched from Pre-AP World Geography to Honors World History. I'm the only 9th grader to EVER take that class, and I feel as though I'm not living up to my full expectations. I was lucky to get into most of my classes, and now I'm getting Bs in some of them. I feel it is my inability to focus on my school work that really "messes me up". Any advice on how I can fix this? I want to graduate as a Junior, because I only need 10.5 credits (I get 6 per year). I just want to do good so I can show that I AM able to do this. That age doesn't matter, but mentality does. I feel like I have something to prove to my new teachers and peers...Please, help me. I don't want to get depressed again, but everytime my teachers pull me in the hall, I just want to cry because I'm afraid it might be bad. This may sound ridiculious, like I'm an emotionally unstable teenager who filled her plate with too much. But that isn't true. I just need some advice, other than my parents...Thanks again. :) more

Open Question: i think my dad and step mom might be getting divorced.?

my dad has been married to my step mom for mm about 5 years and im 14 i have one bilogical brother whos only 7 and my step mom is the only one helping him because he has adhd and he has many other various problems that result in slow learning. if she leaves my dad i will be the only girl around and my brother will have no hope because at this moment my dad lives in texas and i live with my step mom and her two children and my brother in washington state. I will either have to move to Texas and babysit my brother all day everyday for the rest of time till i move out or, my dad will move here and i will still baby sit. either way my dads job pays well and he works very hard long shifts so. before when he was with my mom we went to a daycare and it was HORRIBLE all we did was sit in timeout all day long after school everyday til about 7 because my dad and mom were not together. and my step mom will have to get a job if they divorce [shes a stay at home mom right now] and her kids will as well have to be babysitted. her kids are 11 and 9 so...! however there is one more option for my dad if my step mom leaves him, my dad could sent us to live with my mom in portland oregon wich would be his last result hed probably send us to live with our grandma first, my mother was a very long time drug user and i dont want to move with her and everytime im with her i get very bad 2nd hand smoke cough that is TERRIBLE. anyways any one got any supporting ideas. more

Open Question: Most feral cat/stray critter friendly cities in Washington State?

We want to move to Washington State in 3-5 years. We now manage a feral cat colony in San Antonio, Texas in our backyard...it's more like a sanctuary, really. We spoil, care for,and have neutered/spayed and vaccinated all of our ferals in the colony. When we leave in 3-5 years we are going to rent our home to some Buddhist monks who love and cherish animals like we do so the colony will be safe and nurtured. When we move to Washington State we want to live in a feral cat/stray critter friendly city/town. We were hoping to move to Port Angeles or Sequim but the manufactured home communities we have been looking at seem to not like animals. (We want to find a nice, cozy home for 50K or less with a small yard and this type of community would SEEM like just the thing.) Where can we move to? The Seattle feral cat association tells us to look on their webpage but I can't find helpful information for cities/towns outside of Seattle (Seattle is a bit pricey for us to live in.) Thanks so much, all of you! more

Open Question: My parents are having trouble deciding where they want to move. Help!?

I am going off to college next year and my parents are going to move hopefully sometime this summer. However they are having trouble deciding where they want to go. They definitely do NOT want to be in the Northwest. They are an upper-middle class family with a dog and two kids (me and my older brother). They want to go somewhere nice, and somewhere with nice weather. My dad needs to be somewhat close to a big airport for his job, and my mom wants neighbors. My parents are more conservative but are not religious. They most likely will want to be in suburbs and not in the actual city. My mom would like somewhere that is not barren (she wants trees/water). Here are states that they have narrowed down to: Texas, Kansas, Missouri, Tennessee, Indiana, Ohio, South Carolina, and North Carolina. They are currently looking at Collierville, TN, but are still having trouble deciding if Tennessee is where they want to go. They are a little afraid of going to obscure states just because they are worried there will be an "insider/outsider" mentality. Can you think of any areas/cities that seem like a good fit for them? I can post additional information if needed. Please name the area and describe it a little. more

Open Question: Should I have been charged with disorderly conduct? PLEASE ANSWER ASAP?

According to the Texas Penal Code, you can be charged with disorderly conduct if you do any of these in a public place: 1. Use “abusive, indecent, profane, or vulgar language,” of the kind likely to provoke a physical altercation. These are known legally as “fighting words.” 2. Make an obscene gesture that is likely to start a physical altercation. 3. Use chemicals to make a “noxious and unreasonable odor.” 4. Verbally abuse or threaten another person “in an obviously offensive manner.” 5. Make an “unreasonable noise” in a public place or near a private residence that’s not your own. The law defines “unreasonable” as making a sound that is more than 85 decibel levels after being warned once by a police officer. Remember, this a state law, separate from any local noise ordinances. 6. Get into a fight with another person. 7. Fire a gun, or display a gun with the intention to scare other people. 8. Expose your genitals or anus in a “reckless” manner that disregards anyone else who might see you and be offended. 9. Peek into someone else’s home or motel room, or into a private restroom, shower stall, or dressing room for “lewd or unlawful purposes.” MY STORY: My ex and I were parked under some trees in a secluded area in my neighborhood to talk. In order for you to see what was actually going on in the car, you had to have had no life, came close to the car and peeked through the tinted windows. (I can't actually prove this, but my intentions were never to have sex in a car. I don't put out in vehicles. My ex and I were not doing so well anyway, so let me establish that i just allowed him to take me home and my intentions weren't to do anything else. I've ended the relationship, but i knew how much he loved me so i've been allowing him to spend as much time with me before i move away to college this June; even if that means letting him take me home.) Anyway, so on the way to my house he decided to park in this area to "talk". I agreed that we could pull over and verbally talk about some things. So things get a little emotional, and he starts to cry about how he wishes i'd stay with him and that he didn't want me to leave and blah blah blah...SO, he leans in to kiss me and so i kiss him back to show that i care about him (and all of that other mushy stuff). Things get a little carried away and so he reclines my seat and climbs over on top of me and kiss all over my neck...We spot this woman looking across the street. She was walking a little close and straining her eyes i guess to try to see what we were doing. (The seat was reclined all the way down so we had no idea that she saw us kissing. And the windows were tinted). Now i had on these heels which were burning my legs all day. He asks me "Do your legs still hurt? Would you like me to rub them?" So yea, i let him massage my legs... I let him manipulate me into thinking this was just something he was doing for fun and that he missed me a lot so he just wanted to fool around and touch me a little. This was all just a moment of consolation. So he wanted to remove my pants and rub down my legs...so.. it was a little uncomfortable but i didn't think it was a big deal. As long as i kept everything else on, it was okay to me (i thought for some stupid reason). Now i'm turned side ways not paying attention to what he was doing behind me. He was just supposed to be massaging my legs. His pants are now kind of sagging down and his belt unbuckled like he intended on removing his pants also...That's when these cops come, and bang on the window saying "Alright come on, step out of the car now and don't try to hide anything" So my ex immediately opens the door and gets out so the officer wouldn't think we were trying to hide something. I put my pants and shoes back on, while the officer yanks him out of the car with his pants sagging down a little with his belt unbuckeld. The officer also saw me in my underwear (which looked very suspicious). He charges us with disorderly conduct according to NUMBER 8 of that list above. Which meant that were exposing ourselves recklessly (like mooning) not caring who saw us. Which wasn't true. The officer had to spend like 20 minutes contemplating what he could charge us with. He didn't witness any gentitals or anyone's anus. Where we were parked, you could tell that were not trying to "expose" anything to offend someone. Even if the officer had suspicion, he didn't have suscipcion that were EXPOSING OURSELVES IN A RECKLESS MANNER.We should have just recieved some warning and a call to our parents, but not a ticket that goes up to a $500 fine. What were doing might had been PDA, but there is no law for that in texas. So these are the main points: Secluded area, no sexual intent(just PDA) reclined seats, tinted windows.... DISORDERLY CONDUCT for EXPOSURE IN A RECKLESS MANNER? I don't think so...Let me know if it's worth fighting against, or if i should just plead guilty. more

Open Question: Since liberals don't like red states, would they support them seceding?

Would you like to run your leftist programs without the red states involved? About 1 in 6 people live in New York and California and that would be like 1 in 3 without red states. You could tap into the wealth of these economic powerhouses and run health care and anything else you like. No funds from Texas or the low unemployment Midwest though. They would be part of the secession.I've got an idea for you costco-go tell Indians on reservations and soldiers on military bases your line about lazy azzes. Your azz is likely to get lazy with an arrow up it. Your statistics are pure ignorance. more

Open Question: College Basketball Games of the Night! 3/3/2010...Quick preview and a chance to pick winners and analyze!?

8:00 PM- #2 Kansas vs #5 Kansas State- TV: ESPN360 Im ashamed that this game doesnt get tv coverage, as it is the most important game on the docket. The two best teams in the Big 12 face off for seeding in the conference tourney. Expect to see these teams meet again in the Big 12 tournament final. Matchup to watch: Sherron Collins vs Jacob Pullen- 2 of the best guards in the Big 10 if not the nation square off in what is sure to be a solid duel. My Pick: Kansas wins 78-72 Oklahoma State @ #23 Texas A&M- TV: ESPN2 A very underrated game tonight, these are two tournament teams who have recently taken themselves completely off the bubble. It also features one of the best players in the country, and a frontrunner for National Player of the Year honors in James Anderson. If you haven't seen him play yet, get ready for a show! He will be a top 5 pick in this years draft. Matchup to Watch: Marshall Moses vs Bryan Davis- These two are the physical inside guys on teams which rely mostly on the jumpshot. This means if the shots aren't falling, the game will rely on who is taking over on the glass. Expect a hard fought battle here. My Pick: Oklahoma State wins 92-86 8:00 PM- #20 Temple @ St. Louis TV: Check Local Listings, on FSN here A very underrated game with huge tournament implications. St. Louis is on the bubble, and with a win tonight at home they could move into the field. They had a 7-1 record in February. Matchup to Watch: Lavoy Allen vs Willie Reed- Both 6-9 big guys who can score downlow and crash the glass. My Pick: St. Louis moves into the top 65 with a 65-64 win.Next 3: (Feel free to pickem) Duke vs Maryland (Only consider it a non-story because of how badly Duke murdered them last time) UConn vs Notre Dame Rhode Island vs Charlotte more

Open Question: in a tort case in Texas, how do you obtain your own medical records for the discovery process?

a friend is being sued in a tort case for an std (HSV II) transmission. The plaintiff's are claiming they discovered a document from years ago that the defendant knew of the std. The defendant requested this information from the plaintiff and has yet to receive it, only legal threats. My question is, how can the defendant discover her own records to find out what that supposed document states, if at all, it even exists? Is it a criminal offense if this is an actual document but what if she was not notified of it's existence or did not know? more

Open Question: Are Hospitals secretly taking your kids blood for the govt?

"When state health officials were sued last year for storing infant blood samples without parental consent, they said it was for medical research into birth defects, childhood cancer and environmental toxins. They never said they were turning over hundreds of dried blood samples to the federal government to help build a vast DNA database — a forensics tool designed to identify missing persons and crack cold cases. A Texas Tribune review of nine years' worth of e-mails and internal documents on the Department of State Health Services’ newborn blood screening program reveals the transfer of hundreds of infant blood spots to an Armed Forces lab to build a national and, someday, international mitochondrial DNA (mtDNA) registry. The records, released after the state agreed in December to destroy more than 5 million infant blood spots, also show an effort to limit the public’s knowledge of aspects of the newborn blood program, and to manage the debate around it. But the plaintiffs who filed the lawsuit never saw them, because the state settled the case so quickly that it never reached the discovery phase." http://www.texastribune.org/stories/2010/feb/22/dna-deception/ Welcome to America! We own you, and your child! Please wait in the next available line for your government benefits. Psshhh....that's just "tinfoil". Oh wait. more

Resolved Question: What is your take on twice deported illegal back again this time drunken driving and other traffic violations?

What is your take on twice deported illegal back again this time drunken driving and other traffic violations and lying to police ? Twice-deported Mexican national indicted for illegal re-entry ethiopianreview.com | March 2nd, 2010 at 9:42 pm .LOUISVILLE, Ky. – A twice-deported criminal alien from Mexico was indicted on Monday in federal court for illegally re-entering the United States. The indictment resulted from an investigation conducted by U.S. Immigration and Customs Enforcement (ICE). A federal grand jury in the Western District of Kentucky returned an indictment March 1 against Gualberto Telles-Guerrero, aka Jeremy Romo, 26, on charges of illegally re-entering into the United States after having been previously deported, which is a felony. The indictment alleges that Telles-Guerrero, a Mexican national, was illegally present in the United States after he had been previously deported. He did not have the consent of the U.S. Attorney General or the Secretary of the Department of Homeland Security to re-enter into the United States. According to the indictment, Telles-Guerrero was arrested by local law enforcement on Jan 22 for drunken driving and other traffic violations under the name Jeremy Romo. When ICE agents interviewed him, Telles-Guerrero admitted his true name and that he was in the U.S. illegally. An identity and fingerprint check confirmed that Telles-Guerrero was previously deported in September 2004 and again in April 2007. His previous criminal history includes a 2003 conviction in Texas for aggravated assault causing serious bodily injury. If convicted, Telles-Guerrero faces up to 20 years’ imprisonment and a $250,000 fine. After serving any prison sentence imposed, he will be turned over to ICE for removal from the U.S. “Criminal aliens who have been deported and flagrantly disregard our laws by illegally re-entering the United States should not be surprised to find themselves in court facing up to 20 years in prison,” said Ricardo Wong, field office director for the ICE Office of Detention and Removal Operations in Chicago. “ICE is committed to enhancing public safety by identifying criminals who have been previously deported and dare to re-enter this country illegally.” Assistant U.S. Attorney Laura L. Hall, Western District of Kentucky, is prosecuting the case. An indictment is an accusation only, and that person is presumed innocent until and unless proven guilty. http://www.ethiopianreview.com/news/11919 Didn't supporters of illegals state the police should not check the status of illegals caught drinking and driving that these were really minor crimes and not a deportable offense ? more

Open Question: Why is my state so frickin' CRAZY?
