Several weeks ago, I got into a car accident that was 100% the other party's fault. I went to see my doctor and my personal health insurance company (Blue Cross, provided by my employer) eventually paid for the doctor's bill. Subsequently, I reached a settlement with the other party who paid me personally through the the auto insurance companies. In my situation, I was (technically) compensated twice (money to my doctor and money to myself) for the same injury. I was told that in some states, such as Texas, it is not only legal, but specifically allowed to "double-dip" on personal injury protection if the other driver is at fault. Voting Question: How can I get a deadbeat dad that is in another state served child support papers?

I am trying to get papers served to my ex-husband in Texas. He currently pays but I never know when, and is 8 years in arrears. We have 2 children, 14 and 17. The State of Louisiana Office of Family Support just seems to be dragging their heals and has not set a court date since June 2008. He was a no show of course. My daughter will be 18 in September and I fear that her Dad will stop paying her part. I'm almost positive he will. This support payment was set 15 years ago when he was making $7 an hour. He is making MUCH more now and has a new family. He has not seen our 2 children in 3 1/2 years. I cant even allow my daughter to get a drivers license because my auto insurance will go up. She is willing to work but needs a way to and from. My son needs surgery on his mouth and we don't have health insurance. Ok, I have this car. Mind you I already have the car. I paid $1000 down (including TTL) at a dealer that is "buy here pay here" here in Texas. My wife and I are looking into moving to Oklahoma to be closer to her mother and her family. However, in our contract it states that we cannot take the vehicle out of the state of Texas for more than 30 days without the permission of the lien holder. I am not certain if the car lot will give me permission to take the car out of state. So I am looking into trying to get a loan for the amount I owe on the car which is currently just under $5700.00. I do have bad credit, and so does my wife. But it wouldn't be difficult to pay $1,000 down again to have it financed through a bank. The problem I have had so far is finding a bank that will loan just $5700 on a car. I was going to try applying through my bank, but the minimum amount for financing from them is $7500 and the minimum age on a used car to be financed is 2005 year model. The car I have is a 2004. Its a 2004 Crown Victoria Police Interceptor. In very good shape. Only has 81,000 miles on it and runs and drives great, no mechanical problems or anything like that. Anybody know where I could apply for financing to get a $5700 loan to pay the car off so I am not tied to living in Texas until it is paid off? I am currently paying $360 a month on the car. Already have full coverage insurance as well with the mandatory $500 deductibles. Just basically want the loan to pay the dealer off so I am not stuck living in Texas until the car is paid for. So me being the nice/stupid person I am, I helped my friend out by driving her car to the auto-shop that didn't have inspection or an insurance card. I am only 16 and I got a no insurance ticket and a no inspection ticket. They said besides the insurance paper I need a letter written from my friends mom that I can drive the car, well she said her mom sent it 2 weeks ago yet it still hasn't come in. Resolved Question: My Wife Was Involved In An Auto Accident With A Policeman...Any Recourse?

This one happened in Texas. It was in a school zone, before school and the crosswalk empty, but there were kids waiting to cross with the crossing guard. The officer was called to an accident...he only buzzed 2 times and had his small lights on before zooming through the intersection. My wife had a green light and since no siren was sounding, didn't hear the officer...she could not avoid the accident. She had no time to react as the officer's car raced thru the intersection. She hit the right rear panel of the police car causing only a little damage. Our car suffered a completely damaged front end, however our airbags were not deployed. The city's insurance adjuster says the policeman is immune due to some sort of law that grants him the immunity. I believe the officer was negligent due to the fact that he failed to proceed thru the intersection safely. What kind of recourse do I have? Any help/guidance is appreciated. more

On March 2, 2010 I was involved in auto accident, it is not my fault. When the police checking for insurance and I didn;'t have insurance at the moment, he gave me a ticket. Right after I got home, I purchase the insurance online and pay for premium by EBT check withdraw. After purchase the insurance send me an email with my proof of coverage and my temporary insurance ID card. Couple day later they send me the original ID card. I have to go out of country for 1 months, when I came back check my mail and notice that the insurance company couldn't withdraw the money so I call them back and gave them credit card. SO today when I went to pay for my fine, gave them the copy of my insurance ID, and the clerk check and came back told me that my affect date is on April 6 not the date on the paper. I told her I didn;t know anything about it, and ask her how much I would have to pay for fine. She told me $320 but it will go on my permanent record, then advise me to talk to the DA . I agree and she gave me the number and told me to wait in line for next DA . I told my mom to wait inline while I was running to the car really quick and be right back. When I was outside, 4 police came and handcuff me took me to the back without telling me what I was charge for?? As one officer took me to the room, I ask him what I was charge for?? He didn't tell me except gave me the insurance card I gave to the clerk and told me to be quite. Next they search me and lock me in a room, and then 2 hours later release me because I told them I have a little baby at home . Gave me the case number tell me to call couple days to see when the warrent will be effected . And then turn my self in so and call bail bond to bond me out ??? What my question was it was honest mistake I didn't do it on purpose, I didn't know it . Should I hire a lawyer to represent me and how much would the lawyer would charge med for this?? I was just recently involved in an accident and the insurance company that is responsible to pay for the damages is saying that I need to move my car from storage, because they do not have to pay for the car to remain in storage. Since I live in an apartment complex the car would have to be moved twenty minutes away, which is going to cost quite a bit and then we would have to move it again to an auto body shop back to the area I live in. So I called the place where it was stored to get a quote on how much it would cost to move it and the guy said that our car looks to be totaled and that for them to tow it I would have to pay out of pocket and I will never see that money again. Also, he said, in Texas, it is state law for the insurance company to pay storage and towing fees, he said the insurance is just saying that to get us to move it so they don't have to pay those extra fees. Why is it that so many are up in arms about the fact that it will be mandated that people carry health insurance when 48 of the 50 states require drivers to buy liability insurance to show financial responsibility? The two states that don't are New Hampshire and Wisconsin. Neither of those 2 states are suing the US Government over the mandate of health care coverage. But the states thus far that are - Virginia Florida Alabama Colorado Idaho Louisiana Michigan Nebraska Pennsylvania South Carolina South Dakota Texas Utah Washington Georgia all require the people driving in their state to carry auto insurance! What is the difference?? Isn't this also forcing people to buy what they don't want? Isn't this socialism as well? Why is this okay, but when the federal government - who ends up covering medical bills when the people can't do so - demands people take "financial responsibility" and purchase health insurance so that they don't have to spend so much covering people when the medical costs go up because of lack of payment, suddenly people come out of the woodwork and start screaming "This is Unconstitutional!". You got into an auto accident and no one got a ticket but, you used someones car, there was no insurance, and that person was legally disabled. The state sent them a letter saying they had to turn in their license and tags. The person filed an appeal and the state did not take the license or tags but, the person with the disability cannot renew their tags due to the accident that the other person had in her car. That person needs the vehicle for Doctor's appointments for her and her Mother who has MS. They live in a small town where there is no public transportation and no one to transport them. Is there any exemption for that person so she can get the tags for her vehicle? She is on SSi and cannot afford an attorney and legal aide said they do not handle cases like that. The insurance company totaled the other persons vehicle when it only had a dent in the rear passengers door for $10,000.00. I have searched the web all day and cannot find a thing. I live in Texas but, she lives in Iowa. Legal advice would sure be appreciated. I don't know how to help her. Thanks.She didn't have insurance becaue the car had a mechanical problem and she could not afford, at the time, to repair it. So i just bought a used 87 cadillac from a small car lot in cleburne, tx. When i first went to the lot, the car was broke down with a bad transmission. We agreed that he would install a new rebuilt transmission, new ragtop, new paint, and add wire wheels. I gave him $2400 to get started and was given a receipt that just says "put toward 87 fleetwood will paint, new transmission, etc." i didnt sign anything then but he told me if i didnt like anything i would be given my money back. So i go almost a month later, (suppose to take 2 weeks) which is yesterday, to pick it up. it looks good, sounded good, drove it for a little (since i had to get car insured prior to getting it) and it seemed fine i guess, so i sign the paper work....okay now....so i drive it from cleburne to dallas, park it in a garage overnight. next morning, which is today, i pull it out to take it to the insurance agency so they can take pictures, and notice theres some oil drops on the floor..when i get to the insurance agency and park it starts leaking coolant. (which i didnt see when i was at the lot). so after i finish there i take the car to an auto shop and get a 30 point inspection. Turns out the cars intake manifold, radiator, oil pan and a couple other places all have leaks. a couple of other things were bad which were documented as well. The main concern is the intake which they say has been leaking for a while and is very costy. Now the salesman assured me many times that the car had no leaks what so ever and nothing needed to be done which is certainly not the case...so the problem is that when i went to get the car i had to sign the contract or whatever and it included that as-is condition paper and other stuff. And according to them, of the 2400 i gave, 550 goes to ttl and 1500 of that is the down payment which covers the interest and then the 350 thats left goes towards the cash price. Which was very confusing to me then and i am now starting to realize that it prob wasnt very smart for me to agree to that. now i try to contact them today but no answer so will be goin back to cleburne monday to see what happens. If they do not agree to fix the car, or work something out as far as getting my money back ( which i doubt right about now and is why i am asking here), what can i do or what should i do? or do they have to do one of the two? And according to them, of the 2400 i gave, 550 goes to ttl and 1500 of that is the down payment which covers the interest and then the 350 thats left goes towards the cash price. Which was very confusing to me then and i am now starting to realize that it prob wasnt very smart for me to agree to that. now i try to contact them today but no answer so will be goin back to cleburne monday to see what happens. After the aging General Motors plant where he worked for 23 years was idled about a year ago, Hanley faced a Hobson's choice: Stay with his family and search for an autoworker's salary ($28 an hour) in a county where more than 40 percent of its manufacturing jobs disappeared from 2006 to 2009. Or hang on to his GM paycheck and health insurance and follow the job, no matter where it leads. In his case, it led to Fairfax, Kan., the same place his brother and two brothers-in-law — also GM workers, and now his roommates — landed. For others, it has been Indiana or Texas. The long commute is not just a story of hard times, tough choices and a shrinking American auto industry. It's also a case study of what happens when an aging industrial town loses an anchor, when workers too old to start over and too young to retire are caught in a squeeze and when economic survival means one family, but two far-flung ZIP codes. ___ Hanley is not one to complain. "GM has been good for us," he says. "This whole town knows that." For 90 years, the sprawling plant — it started out building tractors — became a different kind of family business. Through the decades, sons followed fathers onto the line, sometimes rubbing shoulders as they built Chevy Cavaliers, Caprices, Tahoes, Suburbans and more. Hanley's father and brother worked there. So did his father-in-law, two brothers-in-law and an assortment of uncles, cousins, nieces and nephews. But as GM's financial troubles mounted, car and SUV sales fell and gas prices climbed, the automaker closed several plants, eliminating thousands of jobs. Janesville — then the oldest of GM assembly plants — ended production of SUVs in December 2008, months before the automaker received billions of dollars in government loans and filed for bankruptcy. (The factory is on standby status; some hold out hope it will reopen one day.) Some of about 1,200 remaining workers took buyouts or retired; some began new careers. Hundreds more stayed with GM, relocating, commuting or just waiting for an opening. The automaker has about 6,500 laid-off workers nationwide. Even before the doors closed, Hanley began preparing for life after GM. He returned to college to complete two credits he needed for an accounting degree, but an offer in Kansas came first. He didn't hesitate. Auto work these days is like playing musical chairs. You grab an opening where you can. The police was called and we said no police report because they knew he was at fault. She gave false insurance. It was no good for about a month. She gave me all her information, phone,address, and everything. I called her and she said she gave me the wrong policy number, so she gave me another policy number. I know of a USAA insurance client who has filed a fraudulent claim on their insurance. In fact two of them in a two month time span, the first claim they lied about who was the driver of the vehicle at time of accident (real driver had a suspended license) The second one they lied to the adjuster by not revealing their license was suspended, they lied about the circumstances ( they didn't reveal they didn't call police because they were under the influence) they did admit to rear ending the other vehicle but also lied about the exact circumstances and parties involved. And they still haven't filed a police report or accident report to the DMV when required by Texas law when car is undrivable from scene and over $1,000. in damages, the damages to both vehicles exceeded $15,000.00. I can't figure out why USAA didn't investigate. The driver of the other vehicle had a complete different story than the client who was at fault, such as the at fault driver begged them not to call police or report it because they were high and holding illegal drugs,since the driver had baby with her she plead the other girls sympathy that she would go to jail and have her baby taken to CPS. Resolved Question: Are parents liable for 18 yr. old son who refuses to get auto insurance and is in an accident?

Our 18 yr. old son who is still in high school and lives at home refuses to get his own auto insurance policy. The title of the truck is in his name and he owns the truck outright. We had him insured under our own policy when the truck was in our name and when he lived at home previously, but he moved out 8 months ago and we removed him from our auto insurance at that time. He has not had auto insurance since then and recently moved back home but now is refusing to get his own insurance for his truck. If he is ever in an accident, are the parents going to be held liable for damages, etc.? More details: 1) We live in Texas. 2) Our 18 yr. old refuses to work but gets $1200/month in social security checks (in his own name). 3) He does not give us any money to help with expenses. 4) He is on probation already for drug related charges. There is a lady who will have her consular interview in CDJ in the next couple of months. Briefly, her story is as follows: She is a native of Nicaragua. Came to the US in the early 1990's in EWI status. She was arrested in February 1997 for possession of a false auto insurance card in Texas. She was granted Deferred Adjudication for the underlying crime but was picked up by immigration authorities. After an unsuccessful bid for political asylum, she was deported to Nicaragua in October 1997. President Clinton signed the NACARA law in December 1997 allowing nicaraguans to adjust status to lawful permanent resident status. After consulting two prominent immigration attorneys who provided assurances that she qualified under the provisions of NACARA she returned to the US, once again in EWI status. She applied for LPR status under NACARA and was granted an initial employment authorization, which she used to gain a social security number and driver license. She went before the court in Texas regarding the 1997 charge and the case was dismissed outright. She married a US citizen in April, 2000. That same year, her son was born in Houston. So she is now the wife of one citizen and the mother of another. When her appointment date for her adjustment interview came around, she was arrested and removed again from the US for unlawful reentry. She has been living outside the US now for about eight years. Her US Citizen husband petitioned for her and she now has an approved I-130 from USCIS. They are waiting for her appointment with the US Consulate in Ciudad Juarez. Her husband has lived all these years without the benefit of having his spouse in the US. Her son is now 9 and has had to either live outside the US or live in the US without his mother. She has a 21-year-old son who has gained LPR status and a 20-year-old daughter who has done the same. She has two sisters who gained LRP status through NACARA and one of them became a US Citizen last month. So....First question: Should she prepare and file the I-601 and I-212 and forward them to the Consulate now or does she have to bring them to the interview? Second Question: How does she best prepare the waivers for the best shot at being approved? Any other comments, clarifications, or personal experience stories -- any helpful insight you all can add here will be welcome. Here's a little background - My ex and I divorced in 2006. In the original divorce decree we have joint custody (1 week with him and 1 week with me) so there was no child support granted. He's a fireman so he's never been able to have them more than every 3rd day. Once I moved to another town, it was decided that he wouldn't get them during the school week because he didn't want to have to drive them to school the next morning (30 miles). So now he sees them 3 days a month. This also freed him to take a 2nd job as a paramedic in an ER. Now they are 15 and 13. My son is 5 months from getting his license and that's going to make my auto insurance go up a great deal. I finally started asking my ex 6 months ago to help me out financially. After much begging, he started giving me $200 a month. I'm sorry but I can't feed two teenagers and provide for them on that amount. He is making $54,000/yr at the fire dept (no idea what he makes at hospital). He and new wife live in very nice home, 2 new cars, etc. Let's just say that we DON'T...we struggle to the point that I have to buy some of their clothes at second hand stores. Anyway, I went through the Attorney General and requested a modification. The mediation is set for 2/10. What can I expect and can he fight this since the original papers say joint custody? more
