My boyfriend's daughter is over 18 but was still in high school so he is still paying child support. She just graduated early today and has the papers from school to prove it. He would like to get the child support stopped now instead of in May since she is already moving out of her mother's house. Does he just send the papers into the Attorney General's office?We're in Texas the order says age 18 or graduate high school which ever one comes later. She is 18, works, graduated today, and moving in with her older sister tomorrow. more

Open Question: In Texas, do the Courts, and Judges in general, lean towards Child Custody with the birth mother?

History: MY current wife's husband had custody of their two sons. One of the sons claimed abuse by me, which was found untrue, and that resulted in her letting them stay with their father. Essentially, she thought she'd "Let him see how it was to be a single parent full time" and ended up screwing herself (and the kids) in the process. After 1 1/2 years, the 9 yr old (the oldest, and also the one who lied) decided to come live with us again on a permanent basis. When the son brought his decision to the attention of his father, his dad simply said "Bye!". During the time of his custody of both, she paid child support for both children to the father. She even paid full child support for both children for the first year her oldest son lived with us, due to Texas law. Of course, the father gladly took said support money and never offered to return any. During the hearing for his custody being assigned to her, the judge didn't assign her repayment, either. No biggie, because one of the children is back with us where we feel his best interests are at the forefront. During all of this time, my wife and I had a son, who is the childrens step-brother. The youngest is with him still. He's 7 currently. The father is single. He works Tue-Fri and occassionally weekends from 6 am to 4 pm. Due to his schedule, the child wakes at 4AM and goes to whomever's home to wait for delivery to daycare. Then off to school, and back to daycare until the father picks him up around 5PM. He is sent to bed at 8 nightly, but is allowed to watch TV until all hours of the morning, which he frequently does. He's rarely supervised or interacted with at the fathers domicile. Now, my wife is considering seeking custody. She never wanted to break up the two brothers, but she took what she could get when the father put it up on a platter. CUrrently, the 7 yr old is pooping his pants and urinating on floors in his own home, as well as my wife's mother's home. MY wife's mother watches the kids most weekends that the father has visitation of both children (thus enabling his non-parenting.) She's the one who's been trying to find out why her guest room and game room smelled like pee, and finally caught the youngest peeing in her room after months of her investigating the matter. Obviously, this wreaks of emotional issues. The child says he does it because "he can't hold it:", but no medical condition is present. Now that she's attempting to gain custody, we're wondering: A. Do Texas Courts and Judges lean more towards "Children with the mother" B. Do the Courts prefer sibilngs together (I.E. Would two of the 3 siblings living with us lend to a Judges decision) C. Would us being married, in a stable home, with a total of 4 children living with us (My first 2 from my previous marriage, Her oldest 1, and our youngest 1) lend weight to a Courts decision. D. Would her attorney's gender lend to anything in the hearing Thanks in advance for any answers given. We really appreciate it. more

Open Question: Is Texas Guaranteed Student Loan Corp. (TG) considered a federal agency?

I defaulted on a student loan but I've been in a repayment program for the last four months. The representatives at TG tell me that I am no longer in default because I signed up with TG's repayment program and also because I'm making timely payments and I that I will continue to stay out of default if I keep making the scheduled payments. I also asked the TG representatives if TG would take my income tax refund (all the money from my refund) I was told no that they would not take any of my return. My questions, is TG considered a federal agency and do you think TG will garnish my tax refund? The reason I am asking is because I filed my income tax return and I am waiting for the check in the mail. I've been checking on the IRS website to check the status of my return. The "where's my refund" site has explained to me for the past two and a half weeks that my return will be mailed Feburary 26 (yesterday). So I have been checking the site everyday and just now the "where's my refund" site posted this on my "refund status results" page... I know that the interest on child support in Texas is 6%. However, is that 6% accrued on a monthly basis or yearly basis? The remaining individuals are in ICE custody awaiting a hearing before an immigration judge, or pending travel arrangements for removal in the near future. My first three children father is a dead beat. He is 25 thousand dollars behind in child support. Next weekend is his weekend and that is also our daughters first softball game. He doesn't want to let her go. Hes upset with me and taking it out on her. My husband has been raising my son for almost 4 of 5 years of his life, and my sons biological father has never tried to have anything to do with him. He was going to sign over his rights to get out of paying child support but his mother talked him out of it although I promised she would still see him. My husband is in the military and is stationed in Texas, the biological father lives in Florida. I was told I can file adoption papers here without his consent and he will be served with a court date and either have to come here to fight the case or just willingly sign over his rights. My daughter has a 3 month old and she is no longer with the baby's daddy. The baby has my daughters maiden name and the father was not listed in the birth certificate. However, not able to make ends meet she applied for child support and the baby's daddy was furious. She has willing let the family see the child and have access. They have never given her any money but grandmother brought diapers about 3 times. The baby's daddy never gave her any money or diapers. My kids have been on medicaid for about a year now. My ex is required to provide insurance for our three children. He changed jobs last year and during his initial probation with the company his employer did not offer insurance for a three month period. So that's when I decided to apply for medicaid. Once insurance became available I told him not to worry about it since they had medicaid. Their medicaid has expired and i'm not planning to re-enroll them. I am ready to modify his child support since it hasn't been since 2004. got a blue letter in the mail saying "scheduling order and notice on intent to dismiss". original OAG typical child support/custody order between cp & ncp. ncp uninvolved w/child both in visitation and child support (behind $24,000) during the past 9 years. finally june 2009, ncp put on probation for nonpayment. in dec 2009 CPS became involved and removed child from cp & step-cp into kinship care. bc of previous OAG order, ncp served on CPS case as well. permanency hearing in may 2010. i understand that. check. but now a ?TRIAL? has been set as well for june 2010 "on the merits" saying something about a dismissal for want of prosecution? i dont understand any of that?? county clerk website does not allow online access to family court cases to general public. only viewable by lawyers. did some googling but no anwers. can anyone clarify this letter? thank you in advance. more

What laws would be violated for the following: W-2 submitted to the court for child support purposes showing earned amount of $31,758.88 In reality: W-2 true amount earned was 57,031.88 The original amount was covered with a piece of typed number on a page and taped over the acutal amount. This was presented to a family judge in regards to having child support increased due to his income increasing over 20% in a two year time period. What laws has he violated and what could the consequences be? Is is state or federal law? I know he tampered with an official govt document and he falsified information presented to the court, but what would the actual crimes be? Hello. I am wondering if anyone knows If you can sign over rights of a child when you live in missouri and the child lives with the mother in texas? My Husband Has never seen this child and the child is 9 years old. She will not answer the phone or even allow anyone in the family even him to even see the child.. He had found out she was pregnant after he left her in texas to move back to missouri ... My husband is paying child support and is a little behind at the moment ... Here is the story. My husband had a girld with a high school sweet heart. She was dating him and Guy "B". She got pregnant, told my husband it was his. Whe child was 2, my husband married her. She was still sleeping with Guy "B". my husband moved out of state, but he sent her monthly payments, that was not court ordered every month. Ten years later, she filed for divorce, and told my husband that they got a divorce. She sent him the papers that did not mention child support. But he continue to wire, and transfer her money every month through bank accounts. My husband married me, and his ex sent the child to live with him and myself for four years. His son told me that his mom had my husband on child support. My husband contacted her and she said "No", that I was lying and I was just trying to cause confusion. My concern was that if we are sending her $600 a month without a court order, then if there is a child support order, then I would rather send it through child support departments. After this his ex comes and picks up her son after four years, and take him to live with her. A month later, support kids call the house and the Attorney general of Texas sends a letter stating that $25,000.00 is back child support is owed. My husband tries to tell them that he was never served with support papers, that a DNA was never done, and he had no idea that he was even on child support because he was never served, and it was not in their divorce papers. Support kids faxed him over some divorce papers, that had were nothing like the original papers that he received. These showed child support amounts and everything. His ex had remarried, and her last name is lets say, "Smith". She married the other guy that she was involved with when they had originally got married, and the guy she was having an affair with that made them get a divorce in the first place. And to make matters worst. My husbands last name is, lets say, "Doe". Their son is not going by the name of "Doe-Smith". A combination of both of the guys last name. His son is now 19, and although my husband has tried to fight it because he was never served, and it is a possibility that it is the other man's son, Texas Attorney General will even hear it. They are garnishing his wages, taking his taxes all for a child that may not be his, because of her lies. The divorce papers that were sent through support kids were a fraud, and I know it. The paperwork states that she wants her last name restored to "Smith". My question about that is, if my husband was your first husband, and your his last name was, "Doe". How can you get your last name restored to "Smith". Your maiden name is something else, Smith is the husband that you all have now. Is there any help for my husband.The child is now 19, so he is paying arrears. He has been trying to fight this for years. They had joint custody, when the child lived with us for 4 years. As soon as she found out that he knew that he was on child support, she ran up here and swooped the child back up. That was two years ago. The child could be the other guys, that is why my husband left her to begin with, "She is a hore" And the child is now carrying an hypenated last name, my husbands, and the other possible father last name. I believe that support kids tampered with the divorce paperwork, because the original copy that my husband received does not state anything about child support. He gave her money and paid for all of his school activities, because he is a good father, and didn't want CSE to dictate to him how much he needs to give to his son. He paid more per month then the order even stated.I do not know how to reply to answers, so this is for DoNotBuy. Unfortunately, in the laws of my state, even if a man signs a birth certificate, if you were not married, when the child was born, a DNA test must be done. This was never done. I am not belittling her, I am just stating the facts of the case. The reason that I mentioned the fact of her last name is because those papers had to have been falsified, because it could not be possible that in the divorce papers from my husband, (her first husband), that she wants her name restored to her name that is her second husband, the man she is married to now. That is evidence to me that those papers have been falsified. I never said, "CSE falsified the documents" please read with an understanding before you make rude comments, this makes you look illiterate. I said, Support Kids, falsified those papers. It seems strange that CSE has not came after him at all for 18 years, if he had not paid, until those forged divorce papers surfaced.The TX Attorney generals office told us to submit school records that proved that he lived with us, we did, not they said that it does not prove anythings, because although he lived with us in our state and we had proof from the school, such as Grade Cards, enrollment papers, discipline reports, letters from teachers and principals, it did not matter. The reason they changed their minds about this being proof of his residency is because, she continue to collect cash, foodstamp and other government assistance, in her state by stating that the child was still living with her for all of those years when he was not. We turned in receipts, showed bank transfers, money order receipts, canceled checks, and wire transactions receipts for all of those years to show that it was done monthly, but according to them, it was all gifts, and not considered child support. So basically, my husband is screwed, by a messed up system, that does not care about potential fraud. more

Hello. My brothers and his girlfriend broke up (this time for real) a few months ago. She has custody of the kids, but he has visitation rights. He has them every other holiday, first, third, and fifth weekends of the month, and every thursday. We all live in Texas. Well now, out of the blue, she says she's moving to Iowa. Totally random decision on her part. She said she's going to a community college that is going to let her start school mid-semester (which i call BS on cuz ive never heard of a college doing that). Anyway, can she just take the kids? its a 2yr old and a 4yr old. Not only that, the 4yr old has epilepsy and has his neurologist here, also he requires speech and physical therapy, which he is taking here, twice a week. Here's the issue! Okay, first thing's first. I don't understand why I have an account with "transunion" if i myself don't even recall speaking with them (other than for the following) within the entirity of my life. I don't know much about how credit works and so on but here's the following information thats bothering me. First I called transunion and got a representiive after searching for a number to there customer support. Then when i got there they said that because the adress on the account didnt match where im at now that i had to provide two types of information. First of all, this whole case started because im trying to open up a banking account wth chase. So i don't have any bank statements. Second, Im living with a friend so I have no bills. Third I do have my florida ID but thats not enough! Topping it off, I don't even know where they are and im not about to just send my information through the mail to begin with! Okay, so now im wanting to know what to do from there? And even more so , why havn't I heard anything about my credit until now? I've oppened an account a little under a year ago in texas with capital one. I get bank statements but i throw them away, (now i know i shouldnt.) A little over a year ago I had a contract with T-Mobile Cellular. I was unable to pay the final bill and still havn't (I dont see why that'd be a big thing) As for cable bills, rent, electric and phone. All those are general applliances and from what i've been told do NOT fall under your credit score or have little to no effect. Hospital bills are supposably the same way! Well, this is kind of a weird situation. And, I'm sorry, this is going to be kind of a long detail section, because I want to be thorough and get some real advice. My daughter's father and I (we've been separated for 5 years now) has let me and my 2 children stay in an extra room in his house since I had to leave my apartment about 3 1/2 months ago. I have not been able to find work in this time, and have not been able to help with bills or anything much except food (I qualified for food stamps during this time). Since we moved over here, he has told me that he doesn't expect anything from me, money-wise, except help with the electric bill once I am working. Here's where the weirdness starts. When I met him, I was only 17, very innocent and naive, and when we had our child, I let him claim her on his tax return for the year she was born. I had no knowledge of dependency rules, commonlaw marriage rules in Texas, or anything of that nature. After she was a year old, I decided to leave him, and he began to blame me for his financial problems. So, I gave him money here and there at first, to help with the electric, water, house payment, whatever. We were a low-income family, the most I ever made in a year then was 12,000, and he made between 17 and 18,000. I don't know why I gave him money then, because I didn't have to, and as a new single mother, I had enough to worry about. I have kicked myself many times for this, because one of the reasons I left him was that I didn't trust him anymore concerning money. He lies to me a lot, to this day, and he still blames me for a lot of his problems. I cannot bring myself to file for child support from him, because he makes me feel guilty about it, like I'm the one who has done something wrong to him, even though I know better. I'm such a wuss in this area, he was the first guy I ever dumped, and the father of my first child. I thought, if I'm good to him, he will be good to me... but that just wasn't the case. Every year after I left, he would ask me to waive my right to claim my little girl to him, and said he would give me money out of his return. I refused each time. Instead, I would offer him half of whatever the additional amount of the refund was after claiming one dependent, in hopes that he would use the money to provide for her better when he was allowed to keep her, or maybe go back to school and help himself out of his rut, but he just bought computer and video games, or other electronics. And this year, I have a son who is only a year old, and my ex told me that because I get to claim my son, he should get to claim my daughter. He doesn't understand that he doesn't have any right at all to claim her. He didn't provide anywhere NEAR 50% of her support at ANY point except the first year we were still together, and then we split it evenly. In fact, after I left, it was more like 7%, and that 7% is the percentage of the year that she stayed at his house overnight, and I had to provide everything for her then anyway except the house itself! He did not help with clothing, food, toys, childcare, medical expenses, or any emergency situation with her. I am currently going to college to obtain my Master's in Accounting, and have taken income tax classes. I know the rules. I have explained them to him. But he won't give up his blame game long enough to listen to me! I'm at my wit's end right now. I need some help! I don't know why he feels entitled. I am the single mother, who has had her share of difficulties working and going to college with two little kids, and who to this day, has not had the heart to break his bank account by hitting him for child support. I have made ends meet for my little family right up until disaster hit in October last year, when an immediate family member died of cancer. I had to miss a lot of work, because I wanted him to be taken care of at home, and not die in a hospital with no loved ones around. I was fired for a tiny mistake almost right after he passed away, because my boss was already angry about having to adjust the schedule for me. I lost my apartment, was at a loss for what to do, until my ex offered the guest room of his house to us. I worked hard for every paycheck I ever earned, and my children are my world. I know I should not have given him a red cent after I left, and I wish I had never started that trend, because now he expects it! And THEN SOME, this year! He thinks I'm going to just hand him thousands of dollars because we were here. He has matured a lot, especially the last year or so, and has grown as a person, and become a better father to her. But we are still not married, not even dating, and we never will be. I have told him for months that this a strictly platonic arrangement, and that I would help him cover the electricity bill while we were here. Here's the story: My boyfriend and I have 2 kids together. He is very unstable, we'll be good for a few months then he jumps off the deep end. When I was pregnant with 1st child I guess the stress of having a baby got to him when I was 7 months pregnant, so he runs off, lives with random people for awhile, gets in trouble with the law. Baby is born, we get back together, move in together so child support was not issued due to the fact that we were living together. A short while after I'm pregnant again, and a short while after that when I'm once again 7 months pregnant he leaves me, 8 month old, AND his unborn. He runs off, moves in with random people, gets in trouble with the law AGAIN, misses his son being born. And now a few months later we're back together. We are doing very well, except for the fact that I'm still pursuing child support from him even though we are together. My view on it is that he is unstable and I can not take the chance of him running off again and leaving me with not one but two small children. Will the court look at me like I'm crazy? I grew with my grandparents, and havent seen my father in person since I was a baby and i lived on the army base with my parents. He has been in the military since then and travels a lot. My husband wants to hire an attorney to gain custody of his 6 year old daughter. She is miserable with her mother. We were just awarded child support for my fiance's 3 children, from their mother. It is just under 400 a month. The problem is that she is a waitress, and a very shady person. How do they handle things when her paycheck will not be enough to cover her court ordered witholdings? Will they find a way to garnish her tips? I was extended credit by Conn's Furniture in Texas last June....I lost my apartment in August 2009 and tried to return the furniture to Conn's but had no means to get it back to them and they would not come back an get it (I understand its my responsibility). I have not made payments since July due to financial issues. I am now living in Louisiana and Conn's called before Christmas threatening wage garnishment. The amount owed is $2,200. I have 2 questions....first one is which state wage garnishment laws apply? I entered into the contract in Texas, which only allows for wage garnishment for back child support. Second is, this amount seems large but yet small compared to I am sure MANY MANY American's who owe WAY more than I do to creditors, but is this amount worth their while to garnish over? more

I live in Texas and I placed my husband (soon to be ex) on child support. We did it at the OAG office rather than court. At the time that I signed, I didn't read the section that stated I had to live within the state. I would have never signed if I had because I have been looking to move out of Texas for some time.
