By late 2007, the 60-year-old Mexican national was involved in one of the largest health care fraud schemes the region has ever seen, the U.S. Attorney’s Office said. He was sentenced Tuesday to one year and one day in federal prison for helping McAllen cardiologist Dr. Fabian Aurignac bilk Medicare and Medicaid out of more than $1 million. “I didn’t know what the doctor was going,” Torres said in Spanish, dressed in a faded work shirt and slacks while pleading with the judge for leniency. “I sincerely did not know what he was up to.” But prosecutors disagreed. In several recorded conversations, Torres acknowledged his role in rounding up patients for the doctor and paying bribes to day care center staff for access to their clients, said Assistant U.S. Attorney Carolyn Ferko. Torres met Aurignac — who ran McAllen’s Cardiology Care Center on the 700 block of North Ware Road — while peddling his wares at the Valley’s adult day care centers. Since at least 2003, the doctor had been bilking the federally funded health care programs by hiring South American doctors who were not authorized to practice in the United States, giving them pre-signed prescription forms to hand out while he vacationed in Italy and Argentina, and later billing Medicare and Medicaid claiming he had overseen all of the patient visits, according to court documents. Torres’ contacts in the elderly care industry provided just the conduit the doctor needed to expand his fraud scheme, according to a 19-count indictment filed in their case. Aurignac paid Torres to win over management at these businesses and round up patents for treatments that were either unnecessary or never took place. Working as the physician’s middleman, Torres delivered bribes of $150 to $300 to day care managers and gave patients Walmart gift cards to submit to free health screenings. At one such business — La Familia Adult Day Care Center in Harlingen — Aurignac’s employees set up a camper in the parking lot to see patients, another violation of Medicare and Medicaid rules requiring all procedures be conducted in sanctioned medical facilities. The center’s manager — Martha Garcia Alaniz — pleaded guilty in July to one count of receiving kickbacks and was sentenced to one year of probation. For his part, Torres was paid $100 for each session set up with a day care center. In the year that investigators were tracking his activity, he received more than $40,000 from Aurignac. In May, Aurignac agreed to pay back $1.1 million to the federal government for his fraud. He is currently serving a prison term of four-years and nine months. Many doctor's operating in Mexico are U.S. board certified or members of a U.S. Medical Association within their field. Over 20,000 American's live in Puerto Vallarta alone and all of which say that health care is as good as the U.S. So as long as you go to a trusted medical professional with such certifications, you should be fine. Just do your homework first. My question is what if you were to get braces in California and then shortly after move to Texas. The action was based on Dr. Smith’s repeated sexual contact with a psychiatric patient who had a history of being sexually abused, and on his telling his fiancée, who called the patient and insulted her. Mullen, John B., M.D., Lic. #G1123, Mount Pleasant TX On August 21, 2009, the Board and Dr. Mullen entered into a five-year agreed order requiring that he abstain from prohibited substances; that he establish a physician-patient relationship and undergo a complete examination by both a board-certified internal medicine physician and board-certified cardiologist approved by the Executive Director, and if continuing care is recommended Dr. Mullen shall undergo continuing care and treatment by either or both of the physicians for the treatment of any condition that, without adequate treatment, could adversely affect his ability to safely practice medicine; that he obtain an independent medical evaluation from an evaluating psychiatrist; that he continue seeing his counselor; and that he participate in AA at least six times a month. The action was based on Dr. Mullen’s treatment of an emergency room patient while he was intoxicated, resulting in his inability to intubate a patient in respiratory distress. After three unsuccessful attempts the patient died. In addition, Dr. Mullen has serious cardiac issues he has been treating himself. Turner, Richard T., M.D., Lic. #G9237, Valley Mills TX On August 21, 2009, the Board and Dr. Turner entered into an agreed order of restriction by which Dr. Turner agrees not to resume the practice of medicine until he appears before the board and presents evidence that he is competent to practice medicine. The action was based on his inability to practice because of a physical condition and his abuse of alcohol. Klem, Jeffrey, M.D., Lic. #L2379, Beaumont TX On August 21, 2009, the Board and Dr. Klem entered a 15-year agreed order of public reprimand in which Dr. Klem’s license was suspended, the suspension was stayed and Dr. Klem was placed under the following conditions: Dr. Klem may not have direct or indirect contact with patients under the age of 21; when treating patients 21 and older, Dr. Klem must have a chaperone present; he must practice in a group or institutional setting; within 30 days he must submit names of treating psychiatrists to be approved for care and treatment, and within 30 days of approval must begin care and treatment with a psychiatrist and follow the psychiatrist’s recommendations; within one year he must take and pass the Texas Medical Jurisprudence Examination; within one year he must complete the professional boundaries course offered by Vanderbilt Medical Center for Professional Health or the similar course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE); he must present copies of the order to his probation officers in Harris and Jefferson Counties and present his probation orders to his TMB compliance officer; and within 90 days he must pay an administrative penalty of $5,000. The action was based on Dr. Klem’s guilty plea in Beaumont to injury to a child based on three allegations of unwanted sexual contact with a minor child, for which he served six months in Jefferson County Jail, and his guilty plea of injury to a child, a third-degree felony, in 176th District Court in Harris County Olmsted, William R., M.D., Lic. #J1550, Georgetown TX On August 21, 2009, the Board and Dr. Olmsted entered into an agreed order of public reprimand revoking his license, staying the revocation and placing him on probation for 10 years under the following terms and conditions: that he have an independent psychiatric evaluation; that he limit his practice to a group or institutional setting; that within one year he complete the professional boundaries courses offered by Vanderbilt University Medical Center for Professional Health or the University of California San Diego Physician Assessment and Clinical Education (PACE) program; that within 180 days he pay an administrative penalty of $5,000; and that he comply with the terms of his plea agreement in Criminal District Court in Dallas County, including paying a fine, registering as a sex offender, obtaining counseling, performing community service and ceasing contact with children except his own. I have been dating a man in the Military for over a year now. And have recently discovered that he may very well be an narcissist. My suspicions began after I had gotten prego and for medical reason had to have an abortion. About two days later he was joking around about how one of his friends wife who was pregnant was having his baby. At work everyone worships the ground this man walks on. So I began to pay attention to the pattern. He would build me up with compliments and attention and then metaphorically kick me in the gut. He then deployed and he would disappear for like 5-10 days. And then grovel. I had the opportunity to go and see him in Texas before they left over seas. And when I told him about it and who I would be coming with he said she has a bad reputation so if you come out with her it will ruin yours...Who cares didn't he want to see me??? Guess not. We were supposed to talk later that night, because I called him out on his ignoring me type behavior, and acknowledged that I was right and he would be there and treat me better. I texed and called with no response. So I said in a text I can take a hint. He texted back way late in the night that he was busy and apparently that is not good enough for me. When I am quite the opposite, I have stuck by him through thick and thin. Sent him boxes, pics. I gave that man everything and anything, have for a year. With not a whole lot in return except, you are so pretty, next day you have an excuse for everything you don't even try. You have a great body and you are so smart. But do see how people just walk all over you?? You are too nice. Then he disappears for a week Then he is back. Puts me on the pedistool and then knocks me off. In the end when we had our final fight I texted him twice, and he never responded. Went to Iraq..I am so sad I know it needs to be over.But I guess I am in fear he will try and contact me at some point. How do I deal with it??? He is smooth and charming... I am not. And if anyone has tips on how to heal the pain I am feeling please please help!!!!! I'm currently 18 years old and in 2006 I was diagnosed and hospitalized for about a month with conversion disorder due to my parents' divorce. I did suffer from loss of consciousness several times in April and had a panic attack in October of that same year. Before I got my driver's license I had to be referred to the Texas Medical Advisory Board because I checked "yes" on the "Have you ever had loss of consciousness" question. They checked everything out though and I got my license no problem. I haven't had any issues since then but was put on Sertraline (Zoloft) a few weeks ago for depression. I was also diagnosed with exercise-induced asthma in middle school, but I haven't had any need for an inhaler in at least 4 or 5 years (except a couple months ago when I had bronchitis and I was prescribed Albuterol just to help with that). Other than that, I'm really healthy. I take multivitamins every day along with an extra Super B complex supplement and an Iron supplement just for good measure. My dad's a pilot, my mom was in the army, and I've been wanting to join the Air Force since I was really young. I was the drum major of my high school band for two years, made All-State Texas band, and had really good marks in my classes. I really hope I'll pass MEPS and be able to enlist. A friend of mine managed to get out of an abusive situation and is now living with his uncle. My friend stays up late with me, his uncle is someone who goes to bed at like 9pm and wakes up at 5am. My friend is on disability indefinitely, is trying to get healthcare for his child and himself through the state (Texas) along with foodstamps, extra child support, etc but they're having trouble actually getting any sort of paperwork and stuff done. He's a widower, his wife died of cancer a year ago. He's inherited her medical bills for debt. My friend has an eight year old son. This child is out of control, completely out of control. To top things off, the child grew up in the abusive situation and probably picked up on some of the abusive behavior. The child has absolutely no respect for his father. None. My friend doesn't have anywhere else to go if his uncle kicks him out and the child knows this. The child knows that my friend will get in trouble with his uncle if they're too loud while he's sleeping and uses it to his advantage. Anytime the father tries to get his son to do anything, the child throws a huge, loud, screaming temper tantrum. Discipline only makes the child yell louder. He won't go to bed. He won't eat anything other than one or two things. Frankly, I think the child is emotionally and verbally abusing his father. Truth be told, the father's life would be a lot better if he didn't have an ill-behaved brat to care for, he could actually have the freedom to get grants, go to school, go to vocational rehabilitation, live on his own, etc, but he can't do any of that because he has to spend his time watching over the child. I've looked into boarding schools/military schools, and the few I could find are 40,000 dollars a year or something. I'm at a loss of what to do. Should I take them to a doctor, maybe they can prescribe the child some sort of medicine for his behavior? The child acts borderline. The father is severely depressed, cutting and thinking about suicide. I'm being the best support I can be. I have no money to pay their medical bills. They have no way to get care. They should be eligible for medicaid but they're having trouble getting the actual services started. Can the doctor turn them away? Will he just accumulate more debt on top of the tens of thousands dollars he owes for his wife's death that his puny 700 dollars a month will never be able to cover? He's going to have to file bankruptcy to get rid of it all anyhow. Somebody call nanny911 or something.The problem is he can't actually discipline his child, the tantrums get worse. "Stepping up to the plate" isn't exactly easy or even possible, especially when it's the child who's making the parent want to end it. It's not my friend's fault that his wife got cancer and died, that she was the breadwinner. It's not his fault that he's disabled and working a normal job isn't possible. He lost everything and wound up living with family. I have seen this child threaten to strike his dad, throw tantrums in public, and be generally belittling. This child is not a sweet innocent kid, he's the product of living with the previous set of relatives, abusive. I knew a child like this when I was young. The kid acted just like this one does. That child grew up to go to jail for physically abusing his mother. If I acted like him when I was young I'd get whipped with a belt. This kid is rotten to the core. So on jan 30 i had two seizures and in the state of texas you have to be seizure free for 6 months in order to drive. so they sent me forms in april to have filled out by me and my doctor (i had to sign a release for this part) so their medical advisory board could review it. i called them ab a month later and they said it was denied but that there was no specific reason given (i thought so since it hadn't been the 6 months yet). the woman on the phone instructed me to request the same forms the end of june so i could repeat the process closer to the end of the 6 mth period. well i just got a letter "a notice of revocation" which says it will be revoked on 7/12/09 indefinitely if i don't request a hearing. i don't know how this all works and i'm kind of confused. i'm not even really sure what my question is on that. my secondary question is since my doctor was aware that i "used to" (as far as she knows) smoke marijuana, and if she disclosed this on the form (which an area was provided for), could this be a reason for revocation. moreResolved Question: Was I scammed by this high school?
In 2007 of may I was trying to find a way to finish high school and I was young and looking for a way to get my diploma so I did a google search for high school diploma and saw belfordhighschool.com when I went to the site I saw a lot of things that I though was real. So I did the test it required me to do and pass it before i paid 200 and something dollars I ask questions to the advisor about the accreditation and he told me I will not have any problems in getting into universities so I paid the money and every since I have been holding this diploma. So I wanted to go to college so I attended San Joaquin valley college for medical assistant in 2008 and actually graduated. So one I am trying to get in to south university and they are telling me that I cant attend there school because the high school I graduated from is not accredited so I called belford and Mr. Steve told me to tell the university to fax over a rejection letter saying the correct reason why so I did and I started to do some research and saw this website http://en.wikipedia.org/wiki/Talk:Belford_University talking about the school is not accredit and it is a scam. I'm a nurse and I until my license came in I had to say graduate nurse. Under Texas code 301.002 it states that a "nurse" must hold a license (be it professional or vocational). So legally can a RMA state that they are a nurse? I'm only asking because the doctor I see only has RMAs in his office and all claim the title of a nurse though when it came to breaking potentially bad news to me there was no compassion for one and secondly I was told over the phone. Where as a nurse we are trained to tell people in a way that we can provide emotional support! Where was my empathy? Moved to Texas due to career. Girlfriend stated that she would relocate once I was settled (though she did not want me to leave the city we were living). Each day seemed like a year without her. She flew to Texas twice in hopes to convince me to relocate back to her hometown. Each time I said no. I was in a board meeting last week and decided that I could not live without her, called her to say I am coming home and left my job and flew down to be with her. Upon arrival she acted different and stated that I hurt her because I did not return sooner. She stated that she loves me but not as strong as she once did before I left. Flew back to Texas (family lives in Texas) to look for ANOTHER job. Now she calls me daily begging me to come back and marry her?? I am/was (lol) a professional {early/thirties} she is a Medical Student {mid twenties}. I took a blood test. The results came back as postive for Spino Cerebellar Ataxia type 2 (an uncurable/nontreatable degenerative disease). The doctor said I have to go through a MEB now and he will put paperwork in for me to PCS to the states. He said the unit (I forget who, will cut my orders). So the doctor couldn't tell me where I was going exactly since he wasn't part of the PCS-orders process. But he did say they would try to send me to or close to my home or record. Thats in South Dakota though. No Army Bases there. So where might I be sent then? My dentist has improperly billed us for medical charges, then they billed the insurance company and was paid twice. They owed us $2600 for 2 months before finally paying. Plus the insurance company denied a $150.00 charge, the dentist finally admitted they billed it wrong and would correct it, I made them give it to me in writing that they would correct it. It has been a month and they have not resubmitted it to the insurance company. Who do I file a complaint to? I'm not upset with the insurance carrier so I wouldn't file with the Insurance commisioner and the dentist performed proper work so I wouldn't file with the Dental state board. Right? Who else could I contact other than the BBB?Nebula! Wow. I would also suggest that you calm down but you know the reaction generated from that suggestion. Of course my story is chock full of holes!! The first part is a general idea of the problem, the second is my question. I kept the question short to generate more answers. Here's a few more details: I paid $2600. The incorrect ins co was used to calculate the providers discount and when corrected, I was due a credit. The dentist was paid by the ins co within 2 weeks. I was told a check would be issued to me, I was told the check was issued, I was told they would have to check on it, after 2 months of this they credited the credit card back (without telling me.) Also, I paid the $150 charge. I was told it would be corrected 3 times and after waiting 2 months, I asked for it in writing. That was over a month ago. Thanks for making it personal, blaming everyone but the dentist and not answering the question. I'm not sure if this would be cosidered malpractice or if we should just file a complaint and who to file it with. A doctor treating a patien for Bipolar disorder, anxiety, panic attacks, high blood pressure and diabetes. One of the medications for the anxiety and panic disorder is addictive. The patient goes in for his routine exam and refills and the next day realizes he was not given a refill on the panic disorder medication. The doctor is called and asked for a refill 4 days later after the patient has run out of the medication and experiancing severe side effects of withdrawl and panic disorder the doctor call the pharmacy and denies the refill and tells the pharmacy that he needs to see the patient. It states very clearly in all pharmacy information to NOT abruptly stop taking this medication due to extreme pschological and physical side effects of withdrawl. Is this malpractice or just somthing that should be reported to the medical board?If it should be reported then to whom and how to do so. This has caused severe panic attacks and phobia issues for the patient.The patient was seen two weeks ago by this doctor and requested refills on all medications, the doctor spoke of no concerns at that time and the patient is not seeking extra medication but a prescription that this doctor gave for the past three months. I am not speaking of a person taking exess of what was prescribed. The patient was not even aware of the possibility of addiction.The patient requested a refill a week prior to running out and has continued to request until this date which is of 5 days after running out a total 12 days before the doctor bothered to reply and decline the refill. Inside, she found Gilberta Estrada and Gilberta's four young daughters hanging in a closet. Gilberta Estrada, 25, and three of the girls were dead. The youngest, 8-month-old Evelyn Frayre, was alive but in dire need of medical care. Alejandra Estrada pulled the infant from the noose and called 911. The child was listed in good condition at a Fort Worth hospital, Parker County Sheriff Larry Fowler said. Fowler said the hangings appeared to be murder-suicide because the doors were locked from the inside and a relative said Gilberta Estrada had been depressed. He said they had last been seen alive Monday afternoon outside the trailer and things had appeared normal. "My mind cannot get around how all this can happen," Fowler said. "It's almost unthinkable." Filly Echeverria, who said she was the children's godmother, identified the dead children as Maria Teresa Estrada, Janet Frayre and Magaly Frayre. A doctor told me that my bloodwork came back normal and ordered $10,000+ worth of medical tests. I was sick for 5 months and lost 30 pounds. I finally switched doctors and this doctor took one look at my old (transferred) bloodwork and saw that it was NOT normal but rather had high bilirubin and indicated a diseased gallbladder. I had emergency surgery within 4 days and was completely fine. I filed a complained with the Texas Medical Board and after 9 months of investigating they found him at fault and they took corrective action (a slap on the wrist) for not telling me about the abnormal bloodwork. September 6, 2006 To All Concerned: This letter is to inform the news media, general public and more importantly, women who use the birth control pill Levlite 28. In February 2006 my wife Veronica was sent by her doctor to see an OB-GYN Dr. Diane Brinkman at the Austin Regional Clinic in Austin, Texas for imaging of a Fibroid Tumor. My wife should have not have been given this drug at her age. During my wife’s visit Dr. Brinkman recorded my wife’s medical history which aside from the tumor was very good health. My wife advised Dr. Brinkman of her complications with her monthly cycles and the doctor gave my wife 30 day samples of Levlite 28. No verbal or written instructions given. No verbal or written warnings of this drug were disclosed by Dr. Brinkman. After about 3wks of using L28 my wife developed symptoms that appeared that she was in some type of cardiac distress and was rushed to the hospital. She was placed in intensive care for several hours and was diagnosed with massive blood clots in both legs and lungs. She was hospitalized for several days. The damage now is that now my wife must remain on blood thinners for the rest of her life. She cannot lift anything over 20lbs. She must wear a medic alert bracelet at all times. She is easily fatigued. She suffers from chest discomfort and chronic leg pain. She cannot work ever again. (She was earning over $600.00 p/w before this happened) She has been diagnosed with Depression & Anxiety The family discussed this matter and we decided that someone must be made accountable for this and we agreed that Dr. Brinkman in our opinion was negligent and careless with dispersing this drug to my wife. I did extensive research on Levlite 28 and all the appropriate warnings are posted online and with pharmacies that sell it. However samples are not accompanied with warnings and if that is the norm then the responsibility should be with the medical professionals that supply the product to their patients. But what is disturbing about his case is that my wife should never have been given this drug due to her age and history. My wife has never used birth control pills and was not educated properly on the risk. Other doctors and her current cardiologist agreed that this was improper. We at this time have sought legal help from several firms in the Austin area only to be denied because of reasons that mystify us. We are told that Levlite 28 is considered a low hormone, low risk drug and the doctor is not responsible for giving verbal warnings and other law professionals are just interested in going after the drug manufacturer. And of course Texas wonderful lawsuit caps that protect health professionals from frivilous lawsuits. This case by no means is frivilous! Whatever the reasons, my wife is suffering and her life has been changed from someone that was working, shopping, physically active with housework, caring for her grandchildren, etc. Now she mostly sits at home with extremely limited activity. We have discussed this case with family members, friends and strangers and all are outraged and urge us to get legal satisfaction but lawyers are telling us that there is no case or they are not capable of pursuing this case. Well I will not accept this, nor will the rest of our families. So we intend to advise the local public of Dr. Brinkman’s casual issue of Levlite 28 and the risks, we will advise all local & national news agencies and hope they will spotlight this incident and investigate any incidents that mirror the events mentioned above. And we will also spread the events in this letter on the World Wide Web especially to women’s magazines and health websites, and all blogs and bulletin boards that appropriately address medical issues for women. We will also advise all consumer groups and regulatory agencies about this matter as well.
