By late 2007, the 60-year-old Mexican national was involved in one of the largest health care fraud schemes the region has ever seen, the U.S. Attorney’s Office said. He was sentenced Tuesday to one year and one day in federal prison for helping McAllen cardiologist Dr. Fabian Aurignac bilk Medicare and Medicaid out of more than $1 million. “I didn’t know what the doctor was going,” Torres said in Spanish, dressed in a faded work shirt and slacks while pleading with the judge for leniency. “I sincerely did not know what he was up to.” But prosecutors disagreed. In several recorded conversations, Torres acknowledged his role in rounding up patients for the doctor and paying bribes to day care center staff for access to their clients, said Assistant U.S. Attorney Carolyn Ferko. Torres met Aurignac — who ran McAllen’s Cardiology Care Center on the 700 block of North Ware Road — while peddling his wares at the Valley’s adult day care centers. Since at least 2003, the doctor had been bilking the federally funded health care programs by hiring South American doctors who were not authorized to practice in the United States, giving them pre-signed prescription forms to hand out while he vacationed in Italy and Argentina, and later billing Medicare and Medicaid claiming he had overseen all of the patient visits, according to court documents. Torres’ contacts in the elderly care industry provided just the conduit the doctor needed to expand his fraud scheme, according to a 19-count indictment filed in their case. Aurignac paid Torres to win over management at these businesses and round up patents for treatments that were either unnecessary or never took place. Working as the physician’s middleman, Torres delivered bribes of $150 to $300 to day care managers and gave patients Walmart gift cards to submit to free health screenings. At one such business — La Familia Adult Day Care Center in Harlingen — Aurignac’s employees set up a camper in the parking lot to see patients, another violation of Medicare and Medicaid rules requiring all procedures be conducted in sanctioned medical facilities. The center’s manager — Martha Garcia Alaniz — pleaded guilty in July to one count of receiving kickbacks and was sentenced to one year of probation. Resolved Question: Who was at fault in this car accident?

A car is sitting in the driveway of a parking lot waiting to make a turn into a 2 lane, 2-way public road from . Near the exit on the far lane a pickup truck is parked. My wife is traveling in this lane and as she approaches the parked pick-up, to get passed it she partially enters the opposite lane. My wife continues driving assuming the driver of the waiting car would yield the right-of-way to the vehicle on the public road. Unfortunately, the other driver decided to leave the parking lot by attempting to make a right turn. When my wife realized what is happening she tried to stop her car, however at 20 mph she had no chance to stop in time and the two cars collide with my wife's car being hit t-boned (broadsided) at the driver's door. Because the Texas Driver's Handbook states: Any vehicle entering a public road from a private driveway shall yield the right-of-way to "all" vehicles on the public road, I was totally convinced that the other driver was at fault that I filed a claim with the other driver's insurance (Amica). After stalling with a decision until the car was repaired and I was facing a $4000. repair bill, I had no choice but to get my insurance (State Farm) involved. A day later I get a letter from Amica telling me that they did not accept responsibility. Explanation: 1) Their driver was only responsible to make sure that there was no traffic in her lane and 2) that there was a witness that said she saw the car leaving the parking lot having finished half the turn when the collision occurred, therefore my wife was at fault because part of the car was in the other lane. In fact we never disputed this point. I was speechless. Evidently Amica meant all her driver was responsible for doing was looking to her left to make sure no vehicles were approaching, but she was not responsible to look to her right to check for vehicles such as my wife approaching. There was also a pedestrian sidewalk that would have required her to look to the right, in which case she would have seen my wife coming. Finally, 6 months later, we got a letter from State Farm who submitted the claim for arbitration to let us know that the arbitration panel had agreed with Amica. I am still speechless. Anyone out there able to tell me what is wrong with my interpretation of the Texas right-of-way law, or what issue I may be overlooking? PS: The car driven by the other driver was a GMC Yukon 1500 XL with a turning radius of 22 ft. Making a careful drawing of the road and the exit and looking at our damaged car door, I am totally convinced that my wife was passed the pickup and back in her lane. Here's an example of what America thinks: 1. Texans. Socially retarded acts of bravado. Lack of self awareness. Isolationistic in thought. Kind of like someone who was raised under a rock, but the rock was big, so they boast about how big the rock was. There's more, but, man, it's so sad - and they don't even know it! 2. Texas politics. I am a conservative who votes republican. Texans are rednecks who vote republican. should I buy an "I'm with stupid" T-shirt? 3. Tx is a Mexican border state. Complete with roads traveled by drug cartels feeding the increasing violent crime rate, drug use, and ever expanding prison population in Tx. That isn't nice and I don't have this problem in my state. 4. Is EVERYONE in Tx chewing tobacco?? 5. Leading state for hate groups. There are more known hate groups in tx then any other state. They all hate different groups for different reasons. When you get right down to it, no one is safe in tx - not even texans. Testament to tx long tradition of nice, down to earth, clan members and level-headed cult fanatics. 6. There are Two seasons in Tx, hot and hotter. There is a third if you count the hurricane season. A fourth if you count squirrel season. 7. Texas' branding of Tex-mex. Uh, we all know it's just Mexican. Maybe Kansas should capitalize on Cantonese food and call it Kan-Can. It's catchier, and doesn't sound like a gas station when you say it. 8. Over industrialization of undesirable industries. Yes, when you visit tx, you get the full impact of what a cesspool they've made out of their state with factories, oil refineries, and chemical plants. Don't get me wrong, it is good somebody is manufacturing this stuff out there, but, man, you've got to be six flags short of a theme park to live amongst the stench-filled, chemical run-off, heat-fest that is tx. 9. Texas as a state ranks in the top 5 of all states for all major pollutants. Go figure. The EPA says you can't breathe the air for fear of carcinogens, can't drink the water for fear of toxins, can't eat the seafood for fear of mercury poisoning, and the Taiwanese plants spill high levels of run-off into the neighborhoods. That isn't good either! 10. "Clampet" stereotypes which aren't all together untrue. I've never seen any other collective bunch unwittingly living up to negative stereotypes. Perhaps some t-shirts can be air dropped to them. You know, t-shirts that say something like, "thank god i struck oil, cuz my double-wide needs a fixin" 11. Texan's general confusion between pride and reason. there is a healthy pride, and then there is a texan pride. actually, a texan is proud of his state like a branch davidian is proud of his cool-aid. 12. "DON'T MESS WITH TEXAS". Why would I need to mess with Texas when it's already messed up? Resolved Question: NO POLICE REPORT,, NO INSURANCE AT THE TIME, PLEASE HELP..!?

My husband was involved in an accident in December, he had just bought a truck owner to owner and did not have liability on it yet. The accident occured in a bank parking area where he was parked and was on his way out on reverse and the other person was speeding and my husband hit the side of the back of her car. It wasn't anything big, only small damages to her car and basically if you can say nothing happened to his truck. The police arrived but he didn't file a police report on the accident, he only gave my husband a ticket for no insurance. The lady wanted to settle this with my husband directly but her husband on the phone recommended she not do so. Well, now the big problem is here. Her insurance (ALLSTATE) is sending us letters that state that if they find him liable he may be obligated to pay them directly. I talked to them yesterday and they said so far the costs have been $1,499 including a car she rented, and that's not it, they're going to sue him for no insurance plus a deductible, plus any other cost that may come forth, that's easily a total of more than $2,000, easily. I told ALLSTATE that I could buy two cars with that amount. My questions are, why are they already charging us when there isn't even a police report on the accident, they don't even know for sure who was at fault, and what can I do about this. This amount is ridiculous, seriously it wasn't even a big accident, no big damages were made to the car. I could have easily taken care of the costs in fixing that and I'm sure it wouldn't even have gotten up to $1500 !!!! Please help me, I've already tried talking to two attorneys but they said they don't handle these type of cases, only ones where injuries are involved !!! PLEASE HELP HELP HELP!!! But not everybody has made up their mind and these players may just be leaning toward the University of Florida. 1. Seantrel Henderson, OT, St. Paul (MN) Cretin-Durham: Henderson may just be the top player in the 2010 class and is maybe the best offensive line prospect since Orlando Pace. His talent has warranted attention from every major program in the country, especially Florida. With Sharrif Floyd and Ronald Powell committing during the Army game, Henderson may just want to follow these guys down to Gainesville. 2. Jordan Hicks, LB, West Chester (OH) Lakota West: Hicks visited Gainesville a few months and said that his mom fell in love with Coach Meyer. Hicks has also been recruited hard by the in-state Buckeyes and Texas among others. But Hicks is the prototypical linebacker for the Gators defense and he said he really liked the school. Then again, he wouldn't have to go too far to play that same style for Charlie Strong at Louisville. 3. Christian Green, QB/ATH, Tampa (FL) Catholic: When you're the top QB in the Sunshine State, you better know the Gators will have you on their radar. Green has the makings of the perfect Spread QB and is a great athlete, but strong pushes from Miami and Georgia have kept Green from committing to the Gators. Also now that Skip Holtz is in Tampa, Green may just commit to USF. 4. Christian Jones, LB, Winter Park (FL) Lake Howell: Jones is the best prospect to come out of the Orlando area since Lorenzo Edwards, also a Gator. With Jeff Luc commited to FSU, Jones may be a necessity for the Gators as they are also losing all 3 starting linebackers. Jones has the makings to be a star wherever he goes, but he may just find immediate stardom in Gainesville. 5. Matt James, OT, Cincinnati (OH) St. Xavier: Florida would love nothing more than to steal one of the top players in the city away from the Bearcats, therefore adding insult to injury after the sugar bowl beat down. But James also may just be the best offensive lineman in the country other than Henderson. James has the makings of a Jake Long type player and with Florida needing help on the line, James could play right away. We should know where he stands after his visit to florida next weekend. 6. Chaz Green, OT, Tampa (FL) Catholic: idk if he's related to Christian Green (same last name and school) but i do know that he's a fantastic lineman with loads of talent, who was most recently leaning toward tennessee after almost committing to the Gators. now that lane kiffin is gone, Green may just make a 2-man package from Catholic High for the Gators. 7. Ivan McCartney, WR, Miramar (FL): Chad Ochocinco's cousin is one of the most talented receivers in the country and could be a star right away for the Gators. All he has to do is decide between Florida and West Virginia. 8. Dietrich Riley, ATH, La Canada (CA) St. Francis: This guy appeared to be a lock for Gainesville after Matt Elam's short commit to FSU, but with Elam's committment back toward Florida, Riley may just decide to stay in California. However, Riley may just decide he doesn't want to be a Safety and decide to play on the offensive side of the ball for the Gators. 9. Hayes Pullard, ATH, Los Angeles (CA) Crenshaw: Urban Meyer would love nothing more than to steal this talented athlete right out of the heart of USC's recruiting base. But Pullard is also an extremely talented player who could be a dynamite hitter as a linebacker or could be the first hammer running back the Gators have had in the Meyer era. Either way, he's gonna bring the pain. But most likely, he might end up signing with Cal. 10. Michael Taylor, LB, Atlanta (GA) Westlake: This guy has actually already committed to Florida. Just hours after lane kiffin left for USC, Taylor switched his committment to Florida, giving the Gators a very talented outside linebacker and a huge pickup in the Georgia recruiting base. So I live in Texas, and I really like it. I live in the central texas region, just north of Austin. We have a lot of kids from California who come in because the houses are the same size, but often times a large house here, would be the same as a moderately sized house in California. Talking with them they all expected like a desert town, with people riding horses haha.. Due to the state's history, and general reputation, people seem to think we're all hicks and cowboys. I personally really like it here, fine weather, although it gets hot in the summer, good quality air (unless you live in Houston, but no one likes Houston lol) good schools, good job marketplace, good economy... So my question is; How do you guys feel toward the state? try and be as unbiased as possible, preferably if you've visited the Austin area, (I myself live in Cedar Park) and what your opinion was. While some would simply give up when confronted with the daunting task of parenthood, she has faced this task and dealt with it to the best of her ability. From something as trivial as a camping trip, my mother has taught me lifelong lessons that help give direction in my life. (new paragraph) As a young boy, I had always wanted to go camping, fishing, and hiking. I wanted to experience nature at its fullest. Although my mother was not very fond of the idea of camping out at a state park, she agreed to stay for two nights at Buescher State Park. We packed the camping supplies into the car and headed out to the campsite. My mother and I set up the campsite, and we walked to the lake to go fishing. I had never gone fishing before, so mom had to set up the bait and help me cast the line out into the lake. We didn’t catch any fish that day, but the memories will stay with me forever. We came home about an hour before dusk, and mom began grilling steaks for dinner. As nighttime approached, mom began making a campfire so we could make s’mores. She showed me how the fire needed to be constructed so that the flames could get plenty of air. The next morning my mother and I went hiking in one of the trails and we noticed a log crossing the path that looked to be hollow. My mother informed me that you are supposed to step over logs in case there were any bees inside. Mom had always done the things that some people stereotypically reserved for the father in the hope that my childhood would not have any absence of childhood boyish experiences. (New Paragraph) I learned many things during that camping trip. Although, undoubtedly the most important things I learned came not from what she told me or showed me how to do, but from her actions. I became aware of a sense of responsibility to do what I think is right rather than what is easiest. She did not have to take me on the camping trip. She chose to try to give me the best childhood that was possible for her to give me. I was arrested for P.I. at my friends appartment complex in Kenedy, TX Thanksgiving I am 20 and made the Statement "Yes Officer I have had a few" I also gave my correct age when asked ... since this information was given before being placed under arrest it can be used against me without ever being mirandized Correct? Also how can I be proven intoxicated when I never stated that I was.. and no type of sobriety test was given (Field, Breath, nor Blood) The legal definition of intoxication in Texas is having a Blood Alcohol Level of .08% I know this because I am a former bartender and still hold my license to sell. how can i be concidered intoxicated without the results of a test and no conditions where noted on my paperwork suck as slurred speech that type of thing?. Also the address written on my ticket states the address of an upstairs appartment that belongs to my friend. But the incident leading to the police being called happend in the parking lot of said complex and never took place in his appartment. Nor did I state that I was in this appartment either. more

I used to work for a restaurant as a Waitress. The Manager/Owner cuts a lot of corners with her business. The following are just some of the things she does: *She has illegal immigrants working in the kitchen. (Anytime a cop car would pull into the restaurant parking lot, all the cooks would go running out the back door) *In the state of Texas waitresses only get paid $2.13 an hour (becuase we get to keep all of our tips). The manager would make us work 72 hours a week, and wouldn't pay us overtime even though she is required to. *Also, in the state of Texas, for every hour that a waitress is not waiting tables we are supposed to be paid minimum wage (Instead of the usual $2.13 and hour). For example the restaurant opens at 11am, but we would get there at 10am to set up and open the restaurant. For that hour we are supposed to be paid minimum wage, but the manager/owner refused to pay us anything except $2.13 an hour. *When confronting an employee that has done something wrong, she uses curse words and vulgar language instead of acting professionally. *She doesn't keep up with bookeeping, such as the start dates and end dates of employees. *After I quit she didn't send me my last check. I called several times and she refused to come to the phone. I left my address and phone number so she could send me my check and she still hasn't. I quit June 15th 2009 and I still haven't gotten my last paycheck. *I had a torn rotator cuff and couldn't lift trays, so I called her to let her know that. I offered to com in a host, seat tables, clean tables, etc., I just couldn't lift the trays. Her exact words to me were "you are useless to me unless you can lift" followed by a lot of vulgar language. At that point I quit. *She refuses to create a safe working environment. In the kitchen there are slick floors. When they get wet the employees have fallen several times. When I askd her to order some mats to make the floor less slippery for the employees, she said we jsut just be more careful. These are just some of the issues within her business. Hello! I live in California. These are the colleges I want to apply to: Texas A&M Pennsylvania State University - University Park University of Wisconsin - Madison University of Michigan - Ann Arbor University of Illinois - Urbana Champaign University of California - Berkeley Harvard University Yale University (Single Choice Early Action) Princeton University Dartmouth College Massachusetts Institute of Technology Columbia University The first six schools I will put my undergraduate major as Nuclear Engineering. The others as Mechanical Engineering. Well now my stats: I am Asian. GPA: Unweighted 3.0 - 3.24 GPA: Weighted 4.0 - 4.14 I take all IB classes. The reason my grades are so low is because freshmen year I got almost all C's because my dad fell extremely ill, and also my junior year. I didn't get my SAT scores, but PSAT was 203 (80 Math, 61 Writing, 63 Critical Reading). I skipped two grades, so will graduate at the age of 15. I have around 200-300 hours of community service combined when helping out at an elementary school and teaching kids and also while working at an underprivileged help center. If three no parking signs are posted and the two outside signs are pointing in and the middle sign is pointing to the outside signs, (Ex: -> <-> <-) does that mean you can park outside of the signs? Resolved Question: What is the statute of limitations for filing a small claims lawsuit against a former landlord in Texas?

I lived on a rental property in my hometown for a year (say July '04-June '05), paying a $400 security deposit (by check) upon signing the lease. About 8 months later, the property manager retired and someone else took his place. The new manager was really hard to get a hold of, and seemed to lack interest in the issues which needed to be addressed (carbon monoxide, leaky roof and crackhead neighbors!). Her phone would usually go straight to voice mail. Because of this, when my lease was about over I decided to take whatever precautions I could to make sure I didn't get screwed. I left the unit in better condition than it was in when my lease started. The day I moved out (I gave a little over a month's notice) I recorded a video of each room, noting its condition, along with a close-up of the day's newspaper (because she declined doing a walk-through). I turned off all the breakers inside because the crackhead was running an extension cord out her window and using the outside outlets on the other units. I even filmed myself putting the forwarding address and keys in an envelope and sliding them through the office door mail slot (because she wasn't there). Then I waited. Thirty, then 45 days passed with no refund. I called her until she finally answered, and when I asked about my deposit refund, she said she hadn't started working on that month's books yet. So I waited a little longer. Another month or two had gone by, and I decided to go across town to the office and see her in person. To my surprise, the office had been cleared out! I asked the receptionist (it was a small business park) what happened, and she stated that they had just moved out the week before. I asked for a forwarding address, but she said they were still receiving their mail there and just picking it up. About a year later, an acquaintance offered to look into it for me, and wrote a letter stating that legal action would be taken. No reply. I have been in school and/or working since before all this happened, and have let other aspects of my life take priority since then. However, $400 is still a considerable amount of money, but I don't know if it's worth it or even possible to try and get it back. If anything, maybe others in a similar situation could benefit from knowing how much time they have to take action... Sorry this is so long! Just wanted to be thorough. more
