Voting Question: Is this a fair settlement offer for a car accident?

My friend got in an accident in Texas. The other person ran a stop sign and was determined by police report as guilty party. She was going 35 MPH but the airbags did not deploy and the top portion of the seat belt did not lock. Fortunately, the bottom part of the belt held her in her seat but since air bag did not deploy and belt did not lock she hit the top part of the windshield. Her car was totaled out as the front of her car was all smashed in. She walked out of the accident but was taken to the ER for full ct scan. She had a huge bruise on most of her forehead and a long cut around her waist (in the shape of seat belt) and was diagnosed with spasms. Insurance company wants to give her $ 500.00 for loss wages plus ER costs and wants to put a cap of $5K in case she needs to go back for treatment. She feels good at the moment but she is afraid to take this deal as she feels a head injury may show up later on and then $ 5k would not be nearly enough to cover. What should she do? Is this enough? If not, what is a good number? Should she be worried about damage that may not be visible now? Another detail is that tow truck driver an ER’s personnel speculated on the airbag being faulty. Should she look for a lawyer? Insurance co seems very aggressive and are trying to push her to take the least amount possible. They were trying to trick her into literally saying she would not go back to seek medical care as a result of this accident but she did not say it as she is afraid as mentioned above. She is not getting the 5K in cash. Insurance co is just "setting it apart" in case she goes back for medical care. Any help will be appreciated. more

A close friend of mine was recently involved in a severe auto accident in which he was not at fault. He was working/on-the-clock at the time of the accident. A compact car had a blow-out on its doughnut while passing on the shoulder at a very high rate of speed. The tire blew when the driver, who had no drivers license, or it was suspended- he'd only been out of prison for a month...over-corrected when the doughnut blew when it dropped off the shoulder. My friend was driving a 1-ton dually pulling a 10,000 bumper-pull trailer. He had his seat belt on and his air bags both deployed. Upon impact, the truck spun off from the trailer, rolled two times and slammed to a stop against a fence, resting on its drivers side. My friend's ankle was pinned down near the brake pedal. The compact car hit my friend head-on at approximately 88 m.p.h., spun around and hit the trailer, also in the front of the compact car. The entire front end of the car was gone. The car's engine skidded several hundred yards down the road and came to rest, still on fire. The passenger, who owned the car, was deceased, because she was crushed from the neck down. Her boyfriend was flown from the scene. His legs were crushed, he had some other gruesome injuries, and was in a coma for 3 days. He's currently facing 5 different charges. One will be some sort of manslaughter. I cannot remember the proper legal term, but to describe it here, if the toxicology test comes back negative, it'll be involuntary murder and if the toxicology test comes back positive, it'll be voluntary murder. My friend's employer had workman's comp, so my friends medical bills are taken care of, 100%. He's also drawing a good % of his salary so he's not hurting for money right now. He suffered superficial contusions and a severely broken leg which required 2 surgeries because in days gone-by, before the 2 surgery system, this kind of break had a 50% chance of requiring amputation. Consequently, he's now got so many pins in his leg, it literally looks like the Eiffel Tower, or maybe a knitting patter for a nice sweater. He has more pin than bone in his lower leg. No one has mentioned anything about removing these. He's been told that if he follows the doctor's orders, he won't need physical therapy. No one has mentioned anything about him not being able to do everything he did previously. His job isn't riding a pogo stick or anything that would specifically stress that part of his leg. My friend has an attorney, but recently found out that the attorney wasn't representing him for his personal property. That's not really a big deal, but now he's wondering what he should have asked to clarify this, or what he should be asking along the way. For instance, he hasn't been told how much the atty. is seeking on his behalf. All he has been told is: This is a claim right now. If the insurance company denies it, then it becomes a lawsuit. Insurance companies usually pay claims, rather than take them to court, when there is a fatality. The atty. gets 1/3. Workman's Comp gets reimbursed 2nd, after the atty. gets paid. My friend keeps whatever is left over. He's not after a settlement, he just wanted someone involved in his medical care who had his best interest at heart, so to speak. The case is in Texas.If this was your lawyer, what would you be asking/doing, in general? He's just looking for some experience to draw upon, if nothing else, he says. more

Voting Question: Car accident.... I need some help in Conroe Texas?

My car was parked on the street in front of my house and the guy across the street backed out of his driveway VERY fast and hit it. The car was towed to Gullo Ford in Conroe and it has been there for 2 months. They called last week and said it was ready. I went to pick up the car and was driving home and the A/C didnt work...... all the dashboard light began flashing and it died. I called the dealership where it was fixed and they sent a tow truck after it. Now, a week later they call and said the alternator is bad and the a/c went out?? WTF?? They contacted the insurance company and they said they were not going to pay for it? I want the car back to it "pre-accident condition". What do I do? Is there a lawyer in my area that can help me? The dealer now is saying that I owe them for the tow fees and $588 to fix it!! Help!!! more

march 22, 2008 .I was leaving the beach at Port Aransas Texas on the last saturday of spring break , when a truck struck my car when he was reversing and left it unmovable , im checking out the car when a cop tells me to wait on another that is on his way for me.the other police officer tells me to get inside the car on the paseenger side. im thinking he is going to help me get some help to take my car out of the sand, or contact family . he drives me to the station and performs field sobriety test's (only two at that) then arresst me for dwi . i had to wiat one month for me to get a accident report after bonding out , becuase the "officers" that were at the accident were all on "vacation". now im waiting court for the dwi 3rd offense that makes it a felony .. (im only 19 ,doesnt everyone expierment with drugs at this age?) now the at fault insurance company wants to only cover 80 percent ot the damages which are more than 3000 dollars . i allready piad my lawyer 4000 dollars.help! more

Resolved Question: Should my husband tell his employer that he has Parkinson's?

My husband is 46 and recently diagnosed with Parkinson's disease. He has been a truck driver (18 wheeler) for 26 years. He works for a large company and was hired a year ago, passed his physical. He didn't know he had Parkinson's at that time. His neurologist says that he is good to drive for many more years. My husband worries that if he tells his company that he has Parkinson's that they will not want him to drive for them anymore or that they will fire him. He worries that if he were in an accident and didn't tell them about his Parkinson's that they might try to blame the accident on him or his new medications, even if it wasn't his fault. He would like to be upfront with them, but doesn't want to loose his job. We live in Texas. Texas Labor Laws suggested I ask a lawyer. Thank you. more

Last night my stepson his son and his biological father were injured in a car accident. A wrecker carrying a car on a flatbed had not secured the vehical correctly. Just as my stepson saw that it was about to come loose , it did! The car came off the truck and slammed into the passenger side of my stepson's pickup. This sent him into the guardrail. The truck is a total loss. He and his dad were shanken up and are pretty sore but my grandson hit his head, yes he had a seatbelt on, and had to have 12 stitches and stay in the hospital until 2am this morning. My daughter works part time for a lawyer, who came down to the hospital last night. He said he will handle it. Im sure he will, for a fee. What is fair? IF the wrecker company broke more than one law is there more than one lawsuit? I can think of a few. Failure to secure his load. Wreckless endangerment. Bodily injury. Mental anxiety [my wife]. etc more

Resolved Question: Suing after car accident 2 yrs later?

Just less than 2 yrs ago, I was in a wreck in Texas. My truck had no damages and I was not hurt. The other vehicle was from Louisiana. She & her son was not hurt. No police report was made nor did they go to the hospital. My insurance paid for her vehicle damages/rental of car. Today, I received a letter stating she is suing for mental anguish, pain, loss of wages, etc. Also for the child's pain. Can she do this? Do I need a lawyer? Help more
